<br />A violation of the Code shall constitute a civil of Tense punishablc by civil penalty in the amount <br />prescribed hcrcin. <br /> <br />Scction 4. <br /> <br />Oualifications of Spccial Masters. Appointment and Removal. Compensation. <br /> <br />Appointments of Special Masters shall be made by the Manager, as needed. on the basis of <br />experience, skills and abilities and, whenever possible. shall include persons with legal zoning. <br />engineering andlor construction experience. Such appointments shall be made for a term of one <br />(I) year and first time appointments shall be submitted to the Commission tor ratification of the <br />Manager's appointments. <br /> <br />(A) Special Masters need not be residents of the City but shall possess outstanding <br />reputations tor civic pride. intercst. intcgrity. responsibility and business or professional ability. <br /> <br />(13) Appointments shall be made I(lr a term of one (I) year. Special Masters may bc <br />rcappointed or removed. without cause. at the discretion of the Managcr. subject to ratification <br />by the Commission. Appointments to fill any vacancy shall be for the remainder of the unexpired <br />term. Upon the termination of a term of an appointment as Special Master each Special Master <br />shall continue to serve as Spccial Master until a new appointmcnt of a replacemcnt as Spccial <br />Master has been made by the City manager and such ncw appointment has been ratified by the <br />City Commission. The Special Masters so appointed shall servc on a continually rotating basis. <br /> <br />(C) Special Mastcrs shall not be City emplo)'ecs and shall bc compensated at a rate not to <br />excecd $25D per hearing datc. which fec shall includc case preparation. exccution of linal orders. <br />attendance at all hearings including appcals. if necessary. <br /> <br />(D) If a Special Master is removcd ti'om a case in the evcnt of a conflict of intercst. the case <br />may bcassigned to anothcr Special Mastcr. <br /> <br />(E) If requestcd by the Special Master. thc City Attorncy shall scrve as counsel to the Spccial <br />Mastcr. If an appeal is taken. the City Attorney shall represent the City at such proceeding, <br />provided however. if the City Attorney has reprcsented the Prosecutor at the earlier proceeding. <br />slhe may not represent the City in that instance.
