A violation of the Code shall constitute a civil of Tense punishablc by civil penalty in the amount prescribed hcrcin. Scction 4. Oualifications of Spccial Masters. Appointment and Removal. Compensation. Appointments of Special Masters shall be made by the Manager, as needed. on the basis of experience, skills and abilities and, whenever possible. shall include persons with legal zoning. engineering andlor construction experience. Such appointments shall be made for a term of one (I) year and first time appointments shall be submitted to the Commission tor ratification of the Manager's appointments. (A) Special Masters need not be residents of the City but shall possess outstanding reputations tor civic pride. intercst. intcgrity. responsibility and business or professional ability. (13) Appointments shall be made I(lr a term of one (I) year. Special Masters may bc rcappointed or removed. without cause. at the discretion of the Managcr. subject to ratification by the Commission. Appointments to fill any vacancy shall be for the remainder of the unexpired term. Upon the termination of a term of an appointment as Special Master each Special Master shall continue to serve as Spccial Master until a new appointmcnt of a replacemcnt as Spccial Master has been made by the City manager and such ncw appointment has been ratified by the City Commission. The Special Masters so appointed shall servc on a continually rotating basis. (C) Special Mastcrs shall not be City emplo)'ecs and shall bc compensated at a rate not to excecd $25D per hearing datc. which fec shall includc case preparation. exccution of linal orders. attendance at all hearings including appcals. if necessary. (D) If a Special Master is removcd ti'om a case in the evcnt of a conflict of intercst. the case may bcassigned to anothcr Special Mastcr. (E) If requestcd by the Special Master. thc City Attorncy shall scrve as counsel to the Spccial Mastcr. If an appeal is taken. the City Attorney shall represent the City at such proceeding, provided however. if the City Attorney has reprcsented the Prosecutor at the earlier proceeding. slhe may not represent the City in that instance. Special counsel shall be appointcd for that representation. Section 5. Powcrs of the Spccial Master. Special Masters shall have the powcr to: (A) Apply the rules for the conduct of hcarings adopted by the Commission. (8) Subpocna Violators and witnesscs for hearings; subpoenas shall be served by the City Police Departmcnt. or by City Staff. (C) Subpoena cvidence to hearings.
