<br />~ 265-5. Definitions, <br /> <br />DEVELOPMENT PARCEL--- A parcel of land am! watef used for residential or nonresidential <br />structures, accessory structures, utilities, rights-of-way, easements, agriculture, open space and <br />other public or private uses. <br /> <br />GROSS ACRE OR GROSS AREA--- The total area within of a parcel including submerged <br />lands within a Illatted lot. and '.vater. <br /> <br />LOT AREA --- The area enclosed by the exterior boundaries of the lot. No portion of the public <br />or private vehicular rights-of-way adjacent to a lot shall be calculated as plat of the lot's area. <br />Submerged lands shall not be counted as Ilart of the lot's area except where the submerged lands <br />are within the platted lot. Utility or other easements shall not be deducted from the lot area. <br /> <br />NET ACRE OR NET PARCEL AREA--- The total area of a development parcel.,less Net Acre <br />or Net Parcel Area shall not include rights-of-way and land dedicatcd or reserved for public parks <br />or submerged land except where the submerged land is within the plattcd lot of the development <br />project (excluding pri'iate tot lots and private recreation area). <br /> <br />SUBMERGED LANDS---land underneath a water body which mav be used for densitv and <br />intensitv purposes for a development proiect if the land is within the platted lot of the <br />development. <br /> <br />Section 4. Severability. The provisions of this Ordinance are declared to be severable and if <br />any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid <br />or unconstitutional, such decision shall not affect the validity of the remaining sections, <br />sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the <br />legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. <br /> <br />Section 5. <br /> <br />Applicabilitv. This Ordinance shall apply to all zoning applications and approvals. <br /> <br />Section 6. Inclusion in the Code. It is the intention of the Commission, and it is hereby <br />ordained, that the provisions of this Ordinance shall become and be made a part of the code of the <br />City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or <br />relettered to accomplish such intentions; and that the word "ordinance" shall be changed to <br />"section" or other appropriate word, as required. <br /> <br />Section 7. Repealer. All ordinances or part of ordinances in conflict herewith be and the <br />same are hereby repealed. <br /> <br />Section 8. Effective Date.
