<br />ORDINANCE NO. 2007- ~ <;? () <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, CHANGING <br />THE 2007 ELECTION DATE FROM TUESDAY, <br />NOVEMBER 13,2007, TO TUESDAY, NOVEMBER 6, 2007, <br />PURSUANT TO A REQUEST MADE BY THE MIAMI- <br />DADE ELECTIONS DEPARTMENT; ESTABLISHING <br />DECEMBER 4, 2007, AS THE RUN-OFF ELECTION DATE; <br />PROVIDING FOR SEVERABILITY; PROVIDING FOR <br />REPEALER; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, Section 5.1 of the City Charter provides that a general election be held on <br />the second Tuesday, in each odd-numbered year; and <br /> <br />WHEREAS, Section 100.3605, Florida Statutes, provides the City Commission with the <br />authority to change the dates of its election; and <br /> <br />WHEREAS, the Director of the Miami-Dade Elections Department has requested that <br />the City change its election date to coincide with other local elections; and <br /> <br />WHEREAS, this changc would benefit the City and the Elections Department in <br />providing a more efficient and smooth election as well as providing a lower cost to the City; and <br /> <br />WHEREAS, the City Commission wishes to change the City's election date pursuant to <br />the request made by the County's Election Department <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISISON OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section I. Change of Election Date. The City Commission hereby approves the change of the <br />2007 election date from Tuesday, November 13,2007, to Tuesday, November 6,2007. <br /> <br />Section 2. Change of Run-off Date. The City Commission hereby approves the change of thc <br />run-off date from December 1 I, 2007, to December 4,2007. <br /> <br />Section 3. SeverabiIitv. If any section, subsection, clause or provision of this Ordinance is <br />declared invalid or unconstitutional by a court of competent jurisdiction, the remainder shall not <br />be affected by such invalidity. <br /> <br />Section 4. Repeal of Conflicting Provisions. All ordinances, or parts of ordinances in conflict <br />herewith be, and the same, are hereby repealed <br /> <br />Section 5. Effective Date.
