<br />ORDINANCE NO. 2007- ~ <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF <br />THE CITY OF SUNNY ISLES BEACH, FLORIDA, <br />AMENDING SECTION 265-52 OF THE SIGN CODE TO <br />PERMIT A TELEVISION OR COMPUTER MONITOR <br />WITHIN THE WINDOW SIGN AREA; PROVIDING <br />FOR REPEALER; PROVIDING FOR SEVERABILITY; <br />PROVIDING FOR INCLUSION IN THE CODE; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission wishes to permit the use of television monitors within <br />the window sign area; and <br /> <br />WHEREAS, the sign code is required to be amended in order to permit the use of <br />television monitors within the window sign area. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISISON OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clause are hereby <br />ratified and confirmed as being true and correct are hereby made a specific part by this <br />Ordinance upon thereof. <br /> <br />Section 2. <br /> <br />Amendment. Section 265-52 of the Sign Code is amended to read as follows: <br /> <br />~ 265-52 Prohibited signs. <br /> <br />(1) A sign that covers, interrupts or disrupts the major architectural features of a <br />building. <br /> <br />(2) Abandoned signs or signs that relate to a discontinued business or service. <br /> <br />(3) (Reserved) <br /> <br />(4) All signs located on or over public property or right-or-way, except those installed <br />by governmental agencies c r banners attached to publicly approved pole brackets <br />for special event purposes only. <br /> <br />(5) Animated signs, except a television or computer monitor installed in the window <br />SIgn area. <br /> <br />Section 3. Severability. The provisions of this Ordinance are declared to be severable and <br />if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be <br />invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, <br />sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the <br />legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. <br /> <br />Amendment To Sign Code.
