<br />ORDINANCE NO. 2008 - ~ 9 i.., <br /> <br />AN ORDINANCE OF THE CITY OF THE SUNNY <br />ISLES BEACH, FLORIDA, AMENDING SECTION <br />265-47 OF THE CITY CODE RELATING TO <br />DRIVEWAY ST ANDARDS; PROVIDING FOR <br />SEVERABILITY;, PROVIDING FOR INCLUSION IN <br />THE CODE; PROVIDING FOR REPEALER; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, Section 265-47 of the City of Sunny Isles Beach, Florida (the <br />"City") Code provides for driveway standards under the City's zoning code. <br /> <br />WHEREAS, Section 265-47(0) regulates the minimum size requirements for <br />driveways for single-family and duplex structures in all residentially zoned districts; and <br /> <br />WHEREAS, Section 265-47(0) further provides that such driveways shall have a <br />minimum width of 18 feet and a minimum length of 20 feet providing that such 20 feet <br />shall be clear of sidewalks and roadway easements within the confines of the subject <br />parcel; and that driveways for three-car garages shall have a minimum width of 26 feet; <br />and <br /> <br />WHEREAS, Section 265-47(0) should be amended to state that any additional <br />driveway constructed pursuant to this section shall be required to have a minimum width <br />of 12 feet; and <br /> <br />WHEREAS, the City Commission finds that this Ordinance amending Section <br />265-47 of the City Code will improve the driveway standards for single family and <br />duplex structures located in the City's residentially zoned districts. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION <br />OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Section 265-47 of the City Code pertaining to driveway standards is <br />hereby amended by adding the following underscored words and deleting those stricken <br />through, to read as follows: <br /> <br />~ 265-47. <br /> <br />Driveway standards <br /> <br />O. Minimum size. Primary driveways Driveways for single-family and duplex <br />structures in all residentially zoned districts shall have a minimum width of 18 feet and a <br />minimum length of 20 feet providing that such 20 feet shall be clear of sidewalks and <br />roadway easements within the confines of the subject parcel unless otherwise specified in <br />these regulations. Driveways for three-car garages shall have a minimum width of 26 <br />feet. In the event a second driveway is installed to a single family or duplex structures, <br />the secondary driveway shall be required to have a minimum width of 12 feet and must <br /> <br />Ordinance amending Section 265-47 of the City Code - I - <br />
