<br />ORDINANCE NO. 2008 - "2. 91 <br /> <br />AN ORDINANCE OF THE CITY OF THE SUNNY <br />ISLES BEACH, FLORIDA, AMENDING SECTION <br />265-45(E) OF THE CITY CODE RELATING TO <br />FENCES AND WALLS; PROVIDING FOR <br />SEVERABILITY; PROVIDING FOR INCLUSION IN <br />THE CODE; PROVIDING FOR REPEALER; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, Section 265-45 of the City of Sunny Isles Beach, Florida (the <br />"City") Code regulates structures in a required yard or buffer yard area; and <br /> <br />WHEREAS, Section 265-45.E.(2) specifically regulates the height and <br />appearance of fences and walls on a residential lot; and <br /> <br />WHEREAS, Section 265-45.E.(2) provides that fences on a residential lot shall <br />be limited to six feet in height, with fences and walls being limited to four feet in height <br />within a required front yard; and <br /> <br />WHEREAS, Section 265-45.E.(2) should be amended to increase the total <br />permissible height of a front yard fence or wall from four feet to six feet, with the <br />increased height to be permitted to decorative railings; and <br /> <br />WHEREAS, the City Commission finds that this Ordinance amending Section <br />265-45 of the City Code will improve the form, function and aesthetics of fencing or <br />walls located in the City's residential lots. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION <br />OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Section 265-45 of the City Code pertaining to fences and walls in <br />residential lots is hereby amended, by adding the following underscored words and <br />deleting those stricken through, to read as follows: <br /> <br />~ 265-45. <br /> <br />Accessory uses. <br /> <br />E. Fences and walls. <br /> <br />(2) Fences on residential lots. Fences on a residential lot shall be limited to six feet in <br />height. Barbed wire and other similar material shall not be permitted on a fence or wall <br />within a residential district. Fences and walls shall be limited to four feet in height within <br />a required front yard. except that fences with decorative railings shall be limited to six <br />feet in height. Such railings shall be a minimum of six inches apart and shall not obstruct <br /> <br />Ordinance amending Section 265-45(E) of the City Code - I - <br />
