Vera, Assistant ~ity Manager/ Serv~ce Divisiony), <br />Robert Solera, Commuruty Development DIrector ! <br />J <br /> <br />December 13, 2007 <br /> <br />Fences and Walls <br /> <br />RECOMMENDATION <br /> <br />It is recommended that the City Commission approved the attach resolution for a modification to <br />Section 265-45 of the Code of Sunny Isles Beach, specifically as it regulates fence and wall height in <br />the single family residential district. <br /> <br />REASONS <br /> <br />Under Section 265-45 E(2) regulates the height and appearance of fences and walls on single family <br />residential lots. The Code requires that fences or walls be limited to 6 feet in height from the <br />building line to the rear of the property and limiting the fence or wall height in the front yard area to <br />4 feet in height. The intent of the Code was to allow protection for the residences along the front <br />yard and also permit visibility into the lot from the right of way. <br /> <br />An exception to the height requirement for fences on the front yard should be made when a <br />property owner wishes to place decorative fencing that may reach up to 6 feet in height in the front <br />yard. These decorative fences do not obstruct the visibility of the front yard from the right of way. <br />As more and more new single family residences are constructed in the City, the use of the decorative <br />fences in the front yard will increase.
