Part D. Chapter 26 "Elections" Section 26.6 "Qualifying as candidate for Mayor or City Commissioner; fee; oath; single candidate considered elected" of the City Code of the City of Sunny Isles Beach is hereby amended to read as follows: Candidates for the office of Major or City Commissioner shall qualify with the City Clerk no earlier than 9:00 a.m. on the 63r ~tfl day and no later than 4:00 p.m. on the 60th gtfl-day prior to the date of the general election. Section 3. Repealer. All ordinances or parts of ordinances in conflict herewith be, and the same, are hereby repealed. Section 4. Severability. If any section, sentence, clause or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. Section 5. Directions to Clerk. The City Clerk is hereby directed to amend the City Charter in accordance with the election results and this ordinance. Section 6. Inclusion in the Code. It is the intention of the Mayor and City Commission of the City of Sunny Isles Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of the City of Sunny Isles Beach, Florida. The sections of this ordinance may be renumbered or re-Iettered to accomplish such intention, and the word "ordinance" may be changed to "section", "article", or other appropriate word. Section 7. Effective Date. This Ordinance shall be effective ten (10) days after adoption on second reading, except the amendments set forth in Section 2 Part A shall apply only to candidates for the City's General Election held in 2010.
