<br />ORDINANCE NO. 2008--313 <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, AMENDING <br />SECTIONS 14-8 AND 14-10 OF THE CITY CODE RELATING <br />TO THE IMPOSITION AND COLLECTION OF CIVIL <br />PENALTIES IN CODE ENFORCEMENT CASES; PROVIDING <br />FOR REPEALER; PROVIDING FOR SEVERABILITY; <br />PROVIDING FOR INCLUSION IN THE CODE; PROVIDING <br />FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission has the authority to amend its code provISIOns <br />pursuant to Section C-4.3 of the City Charter; and <br /> <br />WHEREAS, the City Commission wishes to amend Section 14-8 paragraph "H" of the <br />Code of the City of Sunny Isles Beach to clarify that civil penalties assessed by the Special <br />Master shall become delinquent if not paid within 10 (ten) days after notice to the violator of the <br />Special Master's decision itemizing the civil penalties; and <br /> <br />WHEREAS, the City Commission wishes to amend Section 14-10 paragraphs "M" and <br />"0" of the City Code to affirm the City's intent to recover its administrative costs in the amount <br />of $75, and limit any mitigation of civil penalties assessed to no less than 50% of the total amount <br />of civil penalty. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a speci fic part by this Ordinance <br />upon adoption hereof. <br /> <br />Section 2. <br />follows: <br /> <br />Amendment. Sections 14-8 and 14-10 of the City Code are amended to read as <br /> <br />~ 14-8. Civil penalties; continued and repeat violations. <br /> <br />H. Civil penalties assessed pursuant to this chapter by the Special Master are due and <br />payable to the City at the close of the hearing and shall become delinquent if not paid <br />within 10 (ten) days after notice to the violator of the Special Master's decision itemizing <br />the civil penalties. er,-i.f If a proper appeal of the Special Master's decision is made, the <br />civil penalties assessed pursuant to this chapter by the Special Master are due and payable <br />to the City when the appeal has been finally decided adversely against the named violator. <br /> <br />Words added underlined, words stfWkeI1 deleted (ed) <br /> <br />Page I of4 <br />
