<br />ORDINANCE NO. 2009- ~3~ <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AMENDING CHAPTER 161 OF THE CITY <br />CODE ENTITLED "FLOOD DAMAGE PREVENTION" TO INCORPORATE <br />ADDITIONAL REQUIREMENTS OF PARAGRAPH 60.3 (e) OF THE NFIP <br />REGULATIONS; ADOPTING THE FLOOD INSURANCE RATE MAP <br />(FIRM) AND THE FLOOD INSURANCE STUDY (FIS) REPORT FOR THE <br />CITY OF SUNNY ISLES BEACH; PROVIDING FOR SEVERABILITY, <br />PROVDING FOR REPEALER; PROVIDING FOR INCLUSION IN THE <br />CODE AND AN EFFECTIVE DATE. <br /> <br />WHEREAS, On August 24, 2007, the Department of Homeland Security's Federal <br />Emergency Management Agency (FEMA) provided our community with Preliminary copies of <br />revised Flood Insurance Rate Map (FIRM) and Flood Insurance Study (FIS) report for the City of <br />Sunny Isles Beach; and <br /> <br />WHEREAS, Because of the modifications to the FIRM and FIS report for our community <br />made by this map revision, certain additional requirements must be met under Section 1361 of the <br />1968 Act, prior to September 11, 2009; and <br /> <br />WHEREAS, The City of Sunny Isles Beach is required, as a condition of continued <br />eligibility in the National Flood Insurance Program (NFIP) to adopt or show evidence of adoption of <br />floodplain management regulations that meet the standards of Paragraph 60.3 (e) of the NFIP <br />regulations; and <br /> <br />WHEREAS, the City of Sunny Isles Beach, on July 15, 1999, adopted Ordinance No. 99-75, <br />on November 13,2001, adopted Ordinance No.2001-142, on April 24, 2003 adopted Ordinance <br />2003-169, and on October 23,2003 Adopted Ordinance 2003-182, its Flood Damage Prevention for <br />the life, health, welfare and safety of its citizens; and . <br /> <br />WHEREAS, the Federal Emergency Management Agency (lfFEMAIf) has identified the <br />City of Sunny Isles Beach as lying within a special flood hazard area; and <br /> <br />WHEREAS, the City wishes to adopt this amendment to the flood damage prevention <br />ordinance, in accordance with FEMA requirements and for the special benefit, health, welfare and <br />safety of its citizens; <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Amendment.
