<br />ORDINANCE NO. 2009- 32~ <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 26-6 OF THE <br />CITY CODE TO REVISE THE QUALIFYING PERIOD DATES OF THE <br />GENERAL ELECTION FOR THE OFFICE OF MAYOR OR CITY <br />COMMISSIONER; PROVIDING FOR REPEALER; PROVIDING FOR <br />SEVERABILITY; PROVIDING FOR INCLUSION IN THE CITY CODE; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, Section 26-6 of the City Code provides that candidates for the office of <br />Malor or City Commissioner shall qualify with the City Clerk no earlier than 9:00 a.m. on the <br />63r day and no later than 4:00 p.m. on the 60th day prior to the date of the general election; and <br /> <br />WHEREAS, the Miami-Dade Elections Department has requested that the City modify <br />the dates for candidate qualifying to no earlier than the 76th day and no later than the 73rd day <br />prior to the date of the general election; and <br /> <br />WHEREAS, with the transition to a paper-based voting system, the State deadlines for <br />several election processes have been moved up; and <br /> <br />WHEREAS, Florida Statutes 101.62(4)(a), provides that absentee ballots must be mailed <br />to overseas voters 45 days before a general election, and this new qualifying period would <br />provide the Elections Department sufficient time to prepare, print, and mail absentee ballots to <br />overseas voters by the statutory deadlines; and <br /> <br />WHEREAS, this change would benefit the City and the Elections Department m <br />providing a more efficient and smooth election; and <br /> <br />WHEREAS, the City Commission wishes to change the City's dates for candidate <br />qualifying pursuant to the request made by the County's Election Department <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISISON OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Recitals adopted. That each of the recitals stated above is hereby adopted and <br />confirmed. <br /> <br />Section 2. Amendment. Section 26-6 of the City Code of the City of Sunny Isles Beach is hereby <br />amended to read as follows: <br /> <br />Section 26-6. Qualifying as Candidate for Mayor or City Commissioner; Fee; Oath; <br />Single Candidate Considered Elected.
