<br />ORDINANCE NO. 2009-.331 <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER <br />233 OF THE CITY CODE TO REVISE FEES FOR SPECIAL <br />EVENTS ON PRIVATE AND PUBLIC PROPERTIES; <br />PROVIDING FOR REPEALER; PROVIDING FOR INCLUSION <br />IN THE CODE; PROVIDING FOR SEVERABILITY; PROVIDING <br />FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, Special Events have forced the City to utilize vital resources to protect the <br />public safety; and <br /> <br />WHEREAS, the Special Events Ordinance IS In need of revision to accommodate <br />changing circumstances. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br />upon adoption hereof. <br /> <br />Section 2. <br /> <br />Amendment. Chapter 233 of the City Code is amended to read as follows: <br /> <br />~ 233-3. Fees <br /> <br />A. <br /> <br />The City Manager or designee may impose such fees as he determines appropriate considering <br />the impact of the special event on the City facilities and services, including without limitation, <br />user fees for particular City properties, rates for exclusive use of public property, and concession <br />agreements for paid admissions, and sale of food, beverage and merchandise on public property. <br />The City Manager may, at his discretion, reduce or waive the submission periods or fees for <br />events by not-for-profit corporations, for a particular event when such waiver is found to be in <br />the best interest of the City. <br /> <br />B. <br />Fees established. <br /> <br />(1) <br />The following fee schedule shall apply for all special event permit applications: <br /> <br />Words added underlined, words stfiGkeR deleted (ed) <br /> <br />Page I 01'5 <br />
