<br />ORDINANCE NO. 2009-~D <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION <br />212 OF THE CITY CODE RELATING TO CONSTRUCTION <br />SITE MAINTENANCE STANDARDS; PROVIDING FOR <br />SEVERABILITY; PROVIDING FOR INCLUSION IN THE <br />CODE; PROVIDING FOR REPEALER; PROVIDING FOR AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission of Sunny Isles Beach finds that construction cranes <br />located in construction areas with no construction activity for 30 (thirty) days or more creates a <br />public nuisance; and <br /> <br />WHEREAS, this public nuisance condition is detrimental to the public peace, welfare <br />and safety of the residents of the City of Sunny Isles Beach. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br />upon adoption hereof. <br /> <br />Section 2. Amendment. Section 212-4 of the City of Sunny Isles Beach Code of Ordinances <br />is amended to read as follows: <br /> <br />~ 212-4. Property maintenance. <br /> <br />D. It shall be the joint responsibility ofthe owner of any property upon which construction is <br />occurring and any contractor responsible for said construction to ensure that all <br />construction materials, waste and trash are contained upon the property. <br /> <br />ill In the event that the Building Official or designee determines that there is no <br />construction activity occurring on a construction site for a period of 30 (thirty) or <br />more consecutive days and there is a construction crane located on said <br />construction site, then the owner( s) of said property and the contractor <br />responsible for operation and/or maintenance of the construction crane shall be <br />iointly responsible for removing the construction crane from the property no later <br />than 15 (fifteen) days following written notice from the City of Sunny Isles <br />Beach.
