Hines, City Clerk <br /> <br />MEMORANDUM <br /> <br />The Honorable City commissio:A..~ <br /> <br />Hans Ottinot, City Attorney ~ \J <br /> <br />November 19,2009 <br /> <br />Ordinance Requiring Removal of Construction Cranes <br /> <br />RECOMMENDATION: <br /> <br />This Ordinance is presented for your consideration. <br /> <br />REASONS: <br /> <br />The crash of the real estate market has forced developers to abandon certain development <br />projects in the City. <br /> <br />The abandonment of development projects have caused several properties to become vacant <br />construction sites. These construction sites have become a public nuisance due to the fact that <br />construction machinery like construction cranes has not been removed from the site. These <br />unused construction cranes pose a danger to the community because the City is located in a high <br />hazard area. Removal of the construction cranes is necessary to protect the public. Staff has <br />requested property owners to remove construction cranes that are located on sites where there is <br />no construction activity. Unfortunately, staffs request has not been acted upon in a diligent <br />manner. <br /> <br />To facilitate the removal of such cranes, staff believes the attached ordinance is necessary. This <br />ordinance requires the removal of construction cranes if the Building Official determines that <br />removal is required because of no construction activity.
