<br />. <br />I <br /> <br />ORDINANCE NO. 2010- ~ <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING <br />SECTION 265-44 OF THE LAND DEVELOPMENT <br />REGULATIONS TO IMPOSE OCCUP ANCY <br />RESTRICTIONS IN SINGLE FAMILY ZONING <br />DISTRICTS; PROVIDING FOR SEVERABILITY; <br />PROVIDING FOR REPEALER; PROVIDING FOR <br />INCLUSION IN THE CODE; PROVIDING FOR AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the City of Sunny Isles Beach is concerned about the negative impact that <br />the number of unrelated persons living in a single dwelling has on single-family neighborhoods; <br />and <br />WHEREAS, under its police power, and decisional law, the City has the authority to <br />enact regulations to maintain the character of single-family neighborhoods; and <br /> <br />WHEREAS, the City finds that excessive numbers of unrelated persons dwelling in <br />single family housing creates excessive noise, traffic, and such gatherings often conflict with <br />family life; and <br /> <br />WHEREAS, the City finds it necessary to adopt this Ordinance to protect the health, <br />safety and welfare of its residents and families. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br />upon adoption hereof. <br /> <br />Section 2. Amendment. Section 265-44 of the Land Development Regulation is amended to <br />read as follows: <br /> <br />9265-44. <br /> <br />Specific use regulations. <br /> <br />N. Occupancy Restrictions in single-family neighborhoods. Homes in single family <br />districts (R-l) are designated for occupancy by a single family, the following definitions apply: <br /> <br />(1.) Definitions: <br /> <br />(a) Family means one (1) or more persons occupying a single residential unit when <br />all members are related by blood, marriage, or adoption and three (3) or less persons unrelated to <br />any other occupant (excluding servants) not be construed to mean fraternity, sonority, club, or <br /> <br />Amending Section 265-44 <br /> <br />Page 1 of3 <br />
