<br />ORDINANCE NO. 2010-~ <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION <br />265-11(K) OF THE LAND DEVELOPMENT REGULATIONS; <br />AND AMENDING SECTION 265-18(C) OF THE LAND <br />DEVELOPMENT REGULATIONS TO PROVIDE FOR <br />ADMINISTRA TIVE APPROVAL OF CERTAIN SITE PLANS; <br />PROVIDING FOR REPEALER; PROVIDING FOR <br />SEVERABILITY; PROVIDING FOR INCLUSION IN THE <br />CODE; PROVIDING FOR AN EFFECTIVE DATE AND <br />APPLICABILITY. <br /> <br />WHEREAS, the City has traditionally used the administrative site plan approval process <br />to approve site plans for governmental facilities since its incorporation; and <br /> <br />WHEREAS, the administrative site plan approval process was incorporated into the City <br />Code when the City utilized the Code of Miami-Dade County as its Code; and <br /> <br />WHEREAS, the administrative site plan approval process was inadvertently removed <br />through amendments of the Land Development Regulations; and <br /> <br />WHEREAS, the City Commission wishes to reaffirm and reestablish the administrative <br />approval of site plans for governmental facilities. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br />upon adoption hereof. <br /> <br />Section 2. <br />follows: <br /> <br />Amendment. Section 265-11 and 265-18 of the City Code is amended to read as <br /> <br />~ 265-11 Development Review Procedures. <br /> <br />K. Quasi-judicial proceedings. The following applications are quasi-judicial and shall <br />comply with the City's quasi-judicial legislation: <br /> <br />(1) Site specific rezoning. <br />(2) Conditional use applications. <br />(3) Variances. <br />(4) Development of regional impact. <br />(5) Plats. <br /> <br />Words added underlined, words stfiekoo deleted (ed) <br /> <br />Page I of3 <br />
