<br />~ <br /> <br />RESOLUTION NO. 2009- J 5D 2J <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE FIRST <br />ADDENDUM TO THE AGREEMENT WITH MARLIN <br />ENGINEERING, INC. TO PROVIDE CONSUL TING CIVIL <br />ENGINEERING SERVICES FOR THE ARCHITECTURAL/ <br />STRUCTURAL DESIGN OF THE REST AURANT, <br />ARCHITECTURAL SERVICES, MECHANICAL, LIGHTING <br />AND PLUMBING DESIGN SERVICES FOR THE NEWPORT <br />FISHING PIER, IN AN AMOUNT NOT TO EXCEED SIXTY-FIVE <br />THOUSAND DOLLARS ($65,000.00), A TT ACHED HERETO AS <br />EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE <br />SAID ADDENDUM TO AGREEMENT; AUTHORIZING THE <br />CITY MANAGER TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THE TERMS OF THE AGREEMENT; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, on January 17, 2008, the City Commission adopted Resolution No. 2008- <br />1198 approving an agreement with Marlin Engineering, Inc., in an amount of Four Hundred <br />Forty-One Thousand Three Hundred Three Dollars ($441,303.00), to provide civil engineering <br />services for the design, specification, and permitting documents for the demolition and <br />reconstruction of the Sunny Isles Beach/Newport Fishing Pier; and <br /> <br />WHEREAS, the City wishes for the Consultant to provide additional services by <br />providing consulting civil engineering services for the architectural/structural design of the <br />restaurant, architectural services, mechanical, lighting and plumbing design services for the <br />Newport Fishing Pier; and <br /> <br />WHEREAS, Marlin Engineering, Inc. has submitted a proposal to provide design <br />parameters of the restaurant to accommodate a building of approximately 5,000 square feet, in an <br />amount of Twenty-Five Thousand Dollars ($25,000.00), and to modify the existing plans of the <br />pier in order to adjust the pier and restaurant dimensions to be that of the existing pier, in an <br />amount not to exceed Forty Thousand Dollars ($40,000.00). <br /> <br />WHEREAS, the City wishes to accept the proposal from Marlin Engineering, Inc., <br />modifying the agreement to include this work, in a total amount not to exceed Sixty-Five <br />Thousand Dollars ($65,000.00), for a total contract amount of Five Hundred Six Thousand Three <br />Hundred Three Dollars ($506,303.00), attached hereto as Exhibit "A". <br /> <br />WHEREAS, the City Commission wishes to amend the Agreement with Marlin <br />Engineering, Inc. for the provision of said services, attached hereto as Attachment "A". <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1.
