<br />specific Residential Area, after 10 days mailed notice is given to all electors of <br />that particular Residential Area. <br /> <br />vi) Notwithstanding any quorum requirements established herein, if at any time the <br />full membership of the Commission is reduced to less than a quorum, the <br />remaining members may, by unanimous vote, appoint additional members to the <br />extent otherwise permitted or required under subsection (c) of Section 2,5 of the <br />Charter. <br /> <br />vii) In the event that all members of the Commission are removed by death, disability, <br />recall, forfeiture of office and/or resignation, the Governor shall appoint interim <br />Commissioners who shall call a special election within not less than 30 days or <br />more than 60 days after such appointment Such election shall be held in the same <br />manner as the first elections under the Charter; provided, however, that if there <br />are less than six months remaining in any of the unexpired terms, such interim <br />Commission appointee(s) by the Governor shall serve out the unexpired terms, <br />Appointees must meet all requirements for candidates provided for in Article 2 of <br />the Charter. <br /> <br />Section 3. Severability, The provisions of this Ordinance are declared to be severable and if <br />any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid <br />or unconstitutional, such decision shall not affect the validity of the remaining sections, <br />sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the <br />legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part, <br /> <br />Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby <br />ordained, that the provisions of this Ordinance shall become and be made a part of the code of the <br />City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or <br />relettered to accomplish such intentions; and that the word "ordinance" shall be changed to <br />"section" or other appropriate word, as required, <br /> <br />Section 5, Repealer. All ordinances or part of ordinances in conflict herewith be and the <br />same are hereby repealed, <br /> <br />Section 6, Effective Date, This Ordinance shall be effective ten (10) days after adoption on <br />second reading, except the provisions relating to the boundaries of the Residential Areas will not <br />take effect until the 2010 municipal election, <br /> <br />PASSED and ADOPTED on first reading the Iq~ day of r::=;.bw~2009, <br />PASSED and ADOPTED on second reading the ~ day of rv\ AR.~\-\ 2009, <br /> <br /> <br />! orman S.
