RESOLUTION NO. 09-Z-..1.l8.- <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, CHANGING THE <br />CLASSIFICA TION FOR THE HERITAGE PARK LAND AREA <br />LOCATED AT 19250 COLLINS AVENUE FROM B-1 <br />(NEIGHBORHOOD BUSINESS) TO CF (COMMUNITY <br />FACILITY); PROVIDING FOR SEVERABILITY; PROVIDING <br />FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission of the City of Sunny Isles Beach authorized the <br />publication of a public hearing as required by the law, that the zoning classification for the <br />Heritage Park land area located at 19250 Collins A venue (hereinafter referred to as the <br />"Property") be changed from B-1 (Neighborhood Business) to CF (Community Facility); and <br /> <br />WHEREAS, said public notice was given and publication made as required by law, and <br />a public hearing thereunder was held on the date of the passage and adoption of this Resolution. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF <br />THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />I. INCORPORATION OF RECITALS <br /> <br />All recitals above are incorporated into the body of this Resolution as if same were fully set forth <br />herein. <br /> <br />II. APPROVAL <br /> <br />That the above described Property be and the same is hereby rezoned and changed from B-1 <br />(Neighborhood Business) to CF (Community Facility): <br /> <br />a. Plans for the Property are on file and may be examined in the Planning <br />and Zoning Department for "Sunny Isles Beach Heritage Park and <br />Parking Garage" consisting of 2 (two) sheets. <br />b. The Property is legally described as "Tract 'D' Gallahad Dade PB 92-16" <br />consisting of 4 (four) acres <br /> <br />III. REPEALER <br /> <br />All Resolutions or parts of resolutions in conflict herewith shall be and hereby are repealed. <br /> <br />IV. SEVERABILITY <br /> <br />If any section, subsection, sentence, clause, phrase, or portion of this Resolution is, for any <br />reason, held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall <br /> <br />2009-Z-ill 19250 Collins Avenue <br />
