RESOLUTION NO. 09-Z-..1.l8.- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, CHANGING THE CLASSIFICA TION FOR THE HERITAGE PARK LAND AREA LOCATED AT 19250 COLLINS AVENUE FROM B-1 (NEIGHBORHOOD BUSINESS) TO CF (COMMUNITY FACILITY); PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Sunny Isles Beach authorized the publication of a public hearing as required by the law, that the zoning classification for the Heritage Park land area located at 19250 Collins A venue (hereinafter referred to as the "Property") be changed from B-1 (Neighborhood Business) to CF (Community Facility); and WHEREAS, said public notice was given and publication made as required by law, and a public hearing thereunder was held on the date of the passage and adoption of this Resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: I. INCORPORATION OF RECITALS All recitals above are incorporated into the body of this Resolution as if same were fully set forth herein. II. APPROVAL That the above described Property be and the same is hereby rezoned and changed from B-1 (Neighborhood Business) to CF (Community Facility): a. Plans for the Property are on file and may be examined in the Planning and Zoning Department for "Sunny Isles Beach Heritage Park and Parking Garage" consisting of 2 (two) sheets. b. The Property is legally described as "Tract 'D' Gallahad Dade PB 92-16" consisting of 4 (four) acres III. REPEALER All Resolutions or parts of resolutions in conflict herewith shall be and hereby are repealed. IV. SEVERABILITY If any section, subsection, sentence, clause, phrase, or portion of this Resolution is, for any reason, held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall 2009-Z-ill 19250 Collins Avenue
