<br /> <br />RESOLUTION NO. 2010- -.J 5 Blo <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING <br />CHANGE ORDER NO.4 TO AGREEMENT WITH TENEX <br />ENTERPRISES FOR CHANGE IN LANDSCAPING AND <br />FOR ADDITIONAL SIDEW ALK AND LANDSCAPE <br />WORK IN AN AMOUNT NOT TO EXCEED SIXTY-FIVE <br />THOUSAND ONE HUNDRED SIXTY DOLLARS AND <br />FORTY-FIVE CENTS ($65,160.45), ATTACHED HERETO <br />AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER <br />TO DO ALL THINGS NECESSARY TO EFFECTUATE <br />THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, the City Commission has long desired to have a consistent <br />streetscape theme along Collins Avenue. <br /> <br />WHEREAS, on October 29, 2009 via Resolution No. 2009-1495 the City entered <br />into an agreement with Tenex Enterprises for the construction for the 183rd Street <br />streetscape improvement and 175th Street median closing for an amount not to exceed <br />Four Hundred Eighty Seven Thousand Six Hundred Thirty-Four Dollars ($487,634.00); <br />and <br /> <br />WHEREAS, on April 15,2010 via Resolution No. 2010-1551 amended the <br />agreement with Tenex Enterprises for the construction for the 183rd Street streetscape <br />improvement and 175th Street median contract closing for additional services in an <br />amount not to exceed Seventy-Five Thousand Six Hundred Sixty-Eight Dollars and <br />Seventy-Five Cents ($75,668.75); and <br /> <br />WHEREAS, on June 17, 2010 via Resolution No. 2010-1573 amended the <br />agreement with Tenex Enterprises for the construction for the 183rd Street streetscape <br />improvement and 175th Street median closing for extension of the paver sidewalk from <br />172 Street to 163 Street in an amount not to exceed One Hundred Twenty-Five Thousand <br />Dollars and ($125,000); and <br /> <br />WHEREAS, Tenex Enterprises has submitted to the City the cost for additional <br />services completed for the 183rd Street Streetscape Improvement Project including but not <br />limited to additional up-lighting of Mejool Palms, street pole lights, driveway <br />modifications, additional median modifications, additional electrical and telephone work <br />and conduits, replacement of water meter boxes, and relocation and repair of irrigation <br />that were incurred during the construction of the project that were not on the plans or part <br />of the agreement; and <br />
