<br />ORDINANCE NO. 2010-~C) <br /> <br />AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AMENDING CHAPTER 96 OF THE CITY CODE <br />PERTAINING TO ALARM SYSTEMS; PROVIDING FOR <br />REPEALER; PROVIDING FOR INCLUSION IN THE CODE; <br />PROVIDING FOR SEVERABILITY; PROVIDING FOR AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the Code Enforcement Division of the Community Development <br />Department is assigned the task of coordinating and regulating alarm system registrations for the <br />City of Sunny Isles Beach (the "City"); and <br /> <br />WHEREAS, Chapter 96 of the City Code regulates alarm systems in the City and the <br />City wishes to amend certain sections pertaining to false alarm notifications and penalties. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br />upon adoption hereof. <br /> <br />Section 2. <br /> <br />Amendment. Chapter 96 of the City Code is amended to read as follows: <br /> <br />~ 96-17 <br /> <br />False Alarm Notifications. <br /> <br />A. The owner/user of an alarm or the person in control of an alarm system shall be subject to <br />fees or penalties concerning his/her alarm depending upon the number of false alarm notifications <br />emitted from an alarm system covered by this chapter within the fiscal year. <br /> <br />B. Ne-p~enalties shall be assessed for the first t\VO false alarms/alarm malfunctions at the same <br />specific alarm site during a fiscal year as follows: <br /> <br />ill Residential premises - no penalty for the first 2 (two) false alarms/alarm malfunctions. <br />ill Commercial premises - no penalty for the first false alarm/alarm malfunction. <br /> <br />~ 96-18 <br /> <br />Schedule of fines; penalties; liens. <br /> <br />D.
