",..:.,. <br /> <br />ORDINANCE NO. 2010-~ <br /> <br />AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AMENDING CHAPTER 33 OF THE CODE OF <br />ORDINANCES PERT AINING TO POST EMPLOYMENT <br />RESTRICTIONS UNDER THE CITY ETHICS CODE; <br />PROVIDING FOR PURPOSE AND LEGISLATIVE INTENT; <br />PROVIDING FOR RULES OF CONSTRUCTION; PROVIDING <br />FOR SEVERABILITY; PROVIDING FOR APPLICABILITY; <br />PROVIDING FOR INCLUSION IN THE CODE; PROVIDING <br />FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the purpose of the Ethics Code set forth in Chapter 33 of the Code of <br />Ordinances of the City of Sunny Isles Beach (the "City") is for City officials and employees to <br />adhere to the highest ethical standards necessary for the efficient and effective operation of City <br />government; and <br /> <br />WHEREAS, in furtherance of this objective, the City Commission reaffirms its treatment <br />of public government as a public trust, using the powers and recourses of public government only <br />to advance public interest and to prevent officials or employees from exploiting public office for <br />personal gain, subordinating the interests of the City to those of a prospective employer, or <br />exerting undue influence on government decision making; and <br /> <br />WHEREAS, the City Commission desires to safeguard public confidence in the integrity <br />of government by being honest, fair, caring, and respectful and by avoiding any conduct which <br />creates the appearance of impropriety or which is otherwise unbefitting a public official or <br />employee; and <br /> <br />WHEREAS, Article VIII, Section 2, Constitution of the State of Florida, as revised in <br />1968, provides for and establishes municipalities and grants to those municipalities <br />governmental, corporate and proprietary powers to enable them to conduct municipal <br />government, perform municipal functions and render municipal services and authorizes said <br />municipalities to exercise any power for municipal purposes, except as otherwise provided by <br />law; and <br /> <br />WHEREAS, Chapter 166, Florida Statutes, known as the "The Municipal Home Rule <br />Powers Act" implements by general law the authority and jurisdiction granted to municipalities <br />by the Florida Constitution and establishes home rule for said municipalities; and <br /> <br />WHEREAS, pursuant to the Home Rule Amendment and Charter of Miami Dade <br />County, Florida, each municipality shall have the authority to exercise all powers relating to its <br />local affairs not inconsistent with the Miami Dade County Charter and shall also have the <br />authority to provide for higher standards than those provided by Miami Dade County in order that <br />its individual character and standards may be preserved for its citizens; and <br /> <br />Words added underlined, words stfi6kefl deleted (ed) <br /> <br />Page I of 5 <br />
