<br />-~ <br /> <br />notice as provided in Chapter 265 of the City Code and who desires to comment at a <br />public hearing on the subject matter. Additionally, the provisions of Subsection P(2) <br />above shall not apply to any former employee whose personal or real property is the <br />subject matter of the judicial. quasi judicial or other proceeding. Finally. the provisions <br />of Subsection P(2) above may be waived upon a written request made to the City <br />Commission if the City Commission finds the comments to be in the public interest or <br />finds the comments necessary to assist in understanding of documents that are deemed <br />public records. The waiver request shall be filed with the City Clerk no later than five <br />business days prior to the judicial. quasi judicial or other proceeding, in which the person <br />seeks to provide a verbal or written comment. <br /> <br />Section 4. Rules of Construction. This Ordinance shall be construed liberally to effectuate its <br />purpose and no exemptions shall be construed unless specifically authorized herein. <br /> <br />Section 5. Severability. The provisions of this Ordinance are declared to be severable and if <br />any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid <br />or unconstitutional, such decision shall not affect the validity of the remaining sections, <br />sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the <br />legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. <br /> <br />Section 6. Applicability. This Ordinance shall apply to all employees and former employees <br />who have not exceeded the two (2) years post employment period from the date of resignation or <br />termination. <br /> <br />Section 7. Inclusion in the Code. It is the intention of the Commission, and it is hereby <br />ordained, that the provisions of this Ordinance shall become and be made a part of the code of the <br />City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or <br />relettered to accomplish such intentions; and that the word "ordinance" shall be changed to <br />"section" or other appropriate word, as required. <br /> <br />Section 8. Repealer. All ordinances or part of ordinances in conflict herewith be and the <br />same are hereby repealed. <br /> <br />Section 9. <br />reading. <br /> <br />Effective Date.
