Summary Minutes: Regular City Commission Meeting September 16,2010

City of Sunny Isles Beach, Florida

7C. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida, Amending
Section 265-210f the City Code to Permit Administrative Approval of a Request to
Combine Condominium Units into a Single Dwelling Unit; Providing for Repealer;
Providing for Severability; Providing for Inclusion in the Code; Providing for an Effective
Date.

Action: City Clerk Hines read the title, and Assistant City Manager/Services Vera reported
that this will establish administrative authority to the City Manager or designee to allow the
combination of condominiums. We have had several requests from unit owners who have
purchased two condominiums and they want to make them into a bigger condo by uniting
them, and they go through the proper building procedures. There are some conditions that
must be satisfied, the condo association has to approve the combination of those units, the
owner must submit a floor plan to the City with the changes, and it has to be approved, and
the owner submits an application to the Property Appraiser's Office requesting the
unification of those two units, and finally the unification of those two units must be
consistent with the Building Code and the Land Development Regulations.

Vice Mayor Thaler said then that this will establish the facts and figures of what they have to
do and so they will not have to come back to the Commission each and every time somebody
wants to put a condo together. Assistant City Manager Vera said that the ordinance will give
staff the authority administratively to approve the unification as long as they provide these
conditions set forth under this Ordinance. Vice Mayor Thaler asked no matter how many
units, and City Manager Conner said that if someone wants to combine two or three condos
into one unit the Administration will handle that, however, if somebody wants to buy half a
building and make it a unit, then we would have the authority to say we don't want the
authority in this unique case and we would come to the Commission for guidance.

Public Speakers: None

Vice Mayor Thaler moved and Commissioner Scholl seconded a motion to approve the
proposed ordinance on first reading. The motion was approved by a roll call vote of5-
o in favor. Second reading, public hearing will be held on Thursday, October 14,2010,
at 6:00 p.m.
Vote: Commissioner Brezin yes
Commissioner Goodman yes
Commissioner Scholl yes
Vice Mayor Thaler yes
Mayor Edelcup ~

7D.
