ORDINANCE NO. 2010-~4 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 265-21 OF THE CITY CODE TO PERMIT ADMINISTRATIVE APPROVAL OF A REQUEST TO COMBINE CONDOMINIUM UNITS INTO A SINGLE DWELLING UNIT; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the concept of combining condominium units into a single dwelling unit has provided residents with an opportunity to expand their living space without re-Iocating; and WHEREAS, the concept of combining condominium units is widely accepted in other progressive communities; and WHEREAS, the concept of combining condominium units may increase the value of the condominium-apartment; and WHEREAS, the City Commission wishes permit administrative approval of the request to combine condominium units within a particular development. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment. Section 265-21 of the City Code is amended to read as follows: ~ 265-21 Certificates of Occupancy. E. Combining Condominium Units. Subsequent to the issuance of a certificate of occupancy an owner of a condominium units may combine two adiacent condominium units into a single dwelling unit. The City Manager or designee may approve request to combine condominium units if the following conditions are satisfied: (1) An owner must submit a letter indicating that condominium association has approved the request to combine the units; (2) Owner must submit floor plans to confirm that the units are physically connected; Words added underlined, words stfiekefl deleted (ed) Page I of3
