RESOLUTION NO. 16-Z - 1 tad <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, ("CITY") APPROVING <br /> VARIANCES FOR CERTAIN GAZEBOS SUBMITTED BY GALINA <br /> GOROKHOVSKY ("APPLICANT") TO INCREASE THE <br /> MAXIMUM ALLOWABLE GAZEBO SQUARE FOOTAGE FROM <br /> 150 SQUARE FEET TO 298 SQUARE FEET, AND TO AUTHORIZE <br /> A REAR SETBACK VARIANCE FOR GAZEBO #2 TO BE ZERO <br /> FEET FROM THE PROPERTY LINE WHERE SIX FEET IS <br /> REQUIRED; PROVIDING THE CITY MANAGER WITH THE <br /> AUTHORITY TO DO ALL THINGS NECESSARY TO <br /> EFFECTUATE THIS RESOLUTION; PROVIDING FOR <br /> SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING <br /> FOR AN EFFECTIVE DATE. <br /> I. RECITALS <br /> WHEREAS, the Applicant Galina Gorokhovsky (the "Applicant") is seeking approval of <br /> two variances for certain gazebos, consisting of a variance for an increase in maximum allowed <br /> gazebo square footage from 150 square feet to 298 square feet, and a rear setback variance for <br /> Gazebo #2 to be zero feet from the property line where six feet is required, and has submitted a <br /> variance application (Application No. PZ2016-11) to the City of Sunny Isles Beach, Florida <br /> requesting the following: <br /> 1. Pursuant to Sections 265-45 and 265-15 of the City of Sunny Isles Beach Land <br /> Development Regulations, the Applicant is requesting a variance for an increase in <br /> maximum allowed gazebo square footage from 150 square feet to 298 square feet. <br /> 2. Pursuant to Sections 265-45 and 265-15 of the City of Sunny Isles Beach Land <br /> Development Regulations, the Applicant is requesting a rear setback variance for Gazebo <br /> #2 to be zero feet from the rear property line where six feet is required. <br /> Legal Description: GOLDEN SHORES OCEAN BLVD EST - SEC C PB 51-93 - LOT <br /> 24 BLK 6 - LOT SIZE 75.000 X 100 - F/A/U 30-2202-009-0530 - <br /> OR 20577-3215 08 2002 1 - COC 24002-2010 11 2005 1 <br /> ADDRESS: 321 191 Street, Sunny Isles Beach, FL 33160 <br /> FOLIO: 31-2202-009-0530 <br /> WHEREAS, on November 17, 2016, the City Commission conducted a public hearing on <br /> this variance application; and <br /> 16-Z- Pool Gazebos Gorokhovsky 1 <br />
