<br />.cD. Unless prohibited by state or federal law or the terms of a collective bargaining <br />agreement all other benefits available to the spouses and children of City employees shall <br />be made available on the same basis to the domestic partner. or child of such domestic <br />partner. of a City employee who has a domestic partner. <br /> <br />@ Notwithstanding the benefits provided for in this article. all non-inconsistent <br />provisions of applicable state. federal or other laws or policies shall apply. <br /> <br />~ Any City employee who obtains or attempts to obtain benefits fraudulently or who fails <br />to notify the City of Sunny Isles Beach of any termination of the Domestic Partnership under <br />this provision shall be subiect to: <br /> <br />ill Recovery of any benefits improperly paid and: <br /> <br />ill Disciplinary action which may include termination. <br /> <br />Further. the City of Sunny Isles Beach may bring a civil action against either or both of the parties to <br />the Domestic Partnership to recover any losses. including attorneys fees. borne by the City as a <br />result of fraudulent request for domestic partnership benefits or because of failure to notify of <br />the termination of the domestic partnership. <br /> <br />Section 4. Severability. If any section, subsection, clause or provision of this Ordinance is <br />declared invalid or unconstitutional by a court of competent jurisdiction, the remainder shall not <br />be affected by such invalidity. <br /> <br />Section 5. Repeal of Conflicting Provisions. All ordinances, or parts of ordinances In <br />conflict herewith be, and the same, are hereby repealed <br /> <br />Section 6. Inclusion In The Code. It is the intention of the City Commission, and it is hereby <br />ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny <br />Isles Beach Code; that the sections of this Ordinance may be renumbered or re-Iettered to <br />accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other <br />appropriate word. <br /> <br />Section 7. Effective Date.
