4.9 The City contemplates award of a firm fixed price contract resulting from this <br />Request for Proposal. The proposal is a citywide project that will commence after <br />the execution of a contract with the City. <br />4.10 Cancellation of Invitations for Bids or Requests for Proposals An Invitation for <br />Bids, or other solicitation may be cancelled, or any or all qualifier may be rejected <br />in whole, or in part, as may be specified in the solicitation, with City's sole <br />discretion. <br />4.11 Correction or Withdrawal of Bids; Cancellation of Awards. In general, bids shall <br />be unconditionally accepted without alteration or correction, except as authorized <br />in this Proposal. However, correction or withdrawal of inadvertently erroneous <br />bids before or after bid opening, or cancellation of awards or contracts based on <br />such bid mistakes, may be permitted, where appropriate. <br />Mistakes discovered before bid opening may be modified, or the bid may be <br />withdrawn by written or telegraphic notice received in the office designated in the <br />invitation for bids prior to time set for bid opening. After bid opening, no <br />changes in bid prices or other provisions of bids, prejudicial to the interest of the <br />City, or fair competition, shall be permitted. In lieu of bid correction, a low <br />bidder alleging a material mistake of fact may be permitted to withdraw its bid if: <br />(1) The mistake is clearly evident on the face of the bid document <br />but the intended correct bid is not similarly evident; or <br />(2) The qualifier submits evidence, which clearly and convincingly <br />demonstrates that a mistake was made. All decisions to permit the <br />correction or withdrawal of qualification, or to cancel awards or <br />contracts based on bid mistakes, shall be supported by a written <br />determination made by the City Manager or his designee. <br />(3) Notwithstanding the foregoing, the City shall have the <br />authority to waive any and all irregularities in any and all <br />qualifiers, or in the alternative, reject any proposal for <br />qualifications. <br />5. Critical Issues. Describe any particular critical issues relating to timeliness or emphasis <br />on particular problem areas, etc. <br />6. Submittals for Qualification. The following documentation must be submitted for <br />qualification of General Contractor: <br />6.1 Letter of Interest to participate in Bidding Process for a "Sidewalks and Street <br />Improvements" — City of Sunny Isles Beach. <br />6.2 An informative, narrative report introducing your firm and location address of the <br />office that will be responsible for the project, including name of the firm's <br />responsible officer, and telephone and fax numbers. <br />Page 3 of 9 <br />RFP - Sidewalk And Street Projects PART] Requests For Proposal <br />
