ORDINANCE NO. 2016 - <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 265 <br /> "ZONING" SECTION 265-46 OF THE CITY CODE TO INCLUDE <br /> PARALLEL AND ANGULAR PARKING REGULATIONS; <br /> PROVIDING FOR SEVERABILITY; PROVIDING FOR <br /> INCLUSION IN THE CODE; PROVIDING FOR REPEAL OF <br /> CONFLICTING PROVISIONS; AND PROVIDING FOR AN <br /> EFFECTIVE DATE. <br /> WHEREAS, the City does not have parallel and angular parking regulations; and <br /> WHEREAS, the City desires to allow parallel and angular parking for development <br /> projects in the City; and <br /> WHEREAS, it is in the best interest of the City, to provide updated regulations that will <br /> promote and secure to the public health, welfare and safety of the City; and <br /> WHEREAS, the City Commission, acting as the City Local Planning Agency, pursuant to <br /> Section 57-2 of the City Code, reviewed and made recommendations regarding the proposed <br /> amendments to the City Land Development Regulations ("LDRs"). <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br /> and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br /> upon adoption hereof <br /> Section 2. Amendment. Section 265-46 of the City Code is amended to read as follows: <br /> § 265-46. - Off-street parking and loading standards. <br /> A. (7) Size and character or required parking. The following design requirements shall be <br /> observed for off-street parking: <br /> (a) Size; parking stalls. Each parking space required and provided pursuant to the <br /> provisions of this article shall be not less than nine feet in width and 18 feet in length <br /> for all commercial and mixed-use developments. Each parking space required and <br /> provided pursuant to the provisions of this article shall be nine feet in width and 18 <br /> feet in length for all residential only developments. Where parallel and angular <br /> parking spaces are used, each parallel and angular parking space shall be not less <br /> than nine feet in width and 23 feet in length. as set forth in Attachment "1". <br /> 1 <br />
