� I CITY OF SUNNY ISLES BEACH Bid No. 01 -09 -01 Page No. 2 PARKS/MEDIANS/RIGHT -OF- WAY MAINTENANCE IT IS THE RESPONSIBILITY OF THE BIDDER TO ENSURE THAT THE BID REACHES THE OFFICE OF THE CITY MANAGER ON OR BEFORE THE CLOSING HOUR AND DATE SHOWN ON THE PUBLIC NOTICE TO BIDDERS FORM. 1.1 PURPOSE OF BID: The City of Sunny Isles Beach intends to secure a source of supply (s) and labor at the lowest responsive and responsible price. The City reserves the right to award the bid considered to best serve the City's interests. 1.2 BIDDER WARRANTY: Bidder warrants that the prices, terms and conditions quoted in the bid will be firm for a period of 365 days from the date of the bid opening unless otherwise stated by the bidder. Incomplete, unresponsive, irresponsible, vague, and ambiguous responses to the iinvitations to bid will be cause for rejection, as determined by the City. 1.3 CONVICTED VENDOR: Pursuant to the provisions of paragraph (2) (a) of section 287.133, Florida Statutes -"A person or affiliate who has been placed on the convicted vendor list following a conviction for a public entity crime may not submit a bid on a contract to provide any goods or services to a public entity, may not submit a bid on a contract with a public entity for the construction or repair of a public building or public work, may not submit bids on leases of real property to a public entity, may not be awarded to perform work as a contractor, supplier, subcontractor, or consultant under a contract with any public entity, and may not transact business with any public entity in excess of the threshold amount provided in section 287.107, for CATEGORY TWO for a period of 36 months from the date of being placed on the convicted ' vendor list ". 1.4 CONE OF SILENCE: You are hereby advised that this Invitation to Bid is subject to the "Cone of Silence" in accordance with Miami Dade County Ordinance Nos. 98 -106 and 99 -1. From the time of advertising until City Manager issues his recommendation, there is prohibition on communication with the City's professional staff. This ordinance does not apply to oral communications at pre -bid conferences, oral presentations before evaluation committees contract discussions made to City Commission during any duly noticed public meeting, contract negotiations with the staff following the award of an RFP, REQ, RFLI, or bid by any City Commission, or communication in writing at any time with any City employee, official, or member of the City Commission unless specifically prohibited. A copy of all written communications must be filed with the City Clerk. Violation of these provisions by any particular bidder or proposer shall not be considered for any REP, RFO, RFLI, or bid for a contract for the provision of goods or services for a period of one year. u
