Hines, CMc, City Clerk <br /> <br />MEMORANDUM <br /> <br />TO: The Honorable City Commission <br /> <br />FROM: Hans Ottinot, City Attorne~ <br />DATE: October 16, 2008 <br /> <br />RE: Ordinance amending Sections 62-8 of the City Code <br /> <br />RECOMMENDATION: <br /> <br />It is recommended that the City Commission approve the attached Ordinance amending Section <br />62-8 of the City Code. <br /> <br />REASONS: <br /> <br />The purpose of the Ordinance amending Section 62-8 of the City Code is to provide additional <br />grounds for the City Manager to select the lowest responsible and responsive bidder. <br /> <br />The following new factors will be added to the selection of the lowest responsible and responsive <br />bidder: 1) whether the provider breached or failed to perform a contract; 2) the claims history of <br />the provider; 3) the performance history of the provider on a City contract or other government <br />contracts; 4) any unresolved claim regarding the provider; and 5) any other cause under this code <br />and Florida law for evaluating the responsibility of the provider. <br /> <br />HO: fa <br /> <br />/ Attachment <br /> <br />Agenda Item ~6 <br />Date ll-I <{? - 0 g <br />
