<br />RESOLUTION NO. 2010 - l.5..9.2- <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, AFFIRMING THE <br />DECISION OF THE CITY'S HISTORIC PRESERV A TION <br />BOARD DESIGNATING TEMPLE B'NAI ZION LOCATED AT <br />200 17STH STREET AS AN HISTORIC SITE; PROVIDING FOR <br />SEVERABILITY; PROVIDING FOR APPEAL; PROVIDING <br />FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, at a public hearing held on June 22, 2010, with notice to the property owner <br />duly provided, the Historic Preservation Board of the City of Sunny Isles Beach (the "Board") <br />designated the Temple B'Nai Zion ("Temple") located at 200 178th Street designated as a historic <br />site under Chapter 171 of the City Code (see attached Exhibit "A" attached hereto and <br />incorporated herein), and <br /> <br />WHEREAS, the Temple appealed the Board's decision rendered on June 22,2010, to the <br />City Commission; and <br /> <br />WHEREAS, on September 2,2010, the City Commission considered the appeal filed by <br />the Temple; and <br /> <br />WHEREAS, the City Commission, after careful consideration of the matter, including <br />the historic designation report prepared by Ellen 1. Uguccioni, the Temple's legal arguments, and <br />all other evidence presented on June 22, 2010, finds that the stated grounds for the Temple's <br />appeal and the facts presented in support thereof do not justify reversing the decision of the <br />Board rendered on June 22, 2010. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE HISTORIC PRESERVATION <br />BOARD OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified <br />and confirmed as being true and the same are hereby made part of this Resolution. <br /> <br />Section 2. Affirming and consenting to historic site designation. The City Commission <br />affirms and consents to the historic site designation decision rendered by the Board on June 22, <br />2010, in all aspects (Resolution No. 2010-13), which resulted in the Temple B'Nai Zion, located <br />at 200 178th Street, and limited to 1) the Main Sanctuary, 2) Portico, and 3) Memorial Tower, <br />being designated as an historic site. In affirming the decision of the Board to designate the <br />Temple as a historic site, the City Commission invites the Temple to submit plans for expansion <br />that are consistent with the City Code and consistent with the designation of the Temple as a <br />historic site. The City Commission expresses its belief that if the structural integrity of the items <br />designated as historic are kept intact, the City Commission will not object to expansion plans that <br />maintain the structural integrity of the historic items. <br /> <br />Page 1 of 2 <br />
