<br />RESOLUTION NO. 2011 - \11.-S' <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, A WARDING BID NO. 11-04-02 <br />TO AND ENTERING INTO AN AGREEMENT WITH CASTLE USA <br />CORPORATION FOR THE DESIGN AND CONSTRUCTION OF <br />THE FABRIC CANOPY STRUCTURE AT HERITAGE PARK, IN AN <br />AMOUNT NOT TO EXCEED ONE HUNDRED TWENTY -EIGHT <br />THOUSAND TWO HUNDRED THIRTY -SIX DOLLARS <br />($128,236.00), ATTACHED HERETO AS EXHIBIT "A", BASED ON <br />THE TERMS, AND CONDITIONS LISTED IN THE BID RESPONSE, <br />ATTACHED HERETO AS ATTACHMENT "A"; AUTHORIZING <br />THE MAYOR TO EXECUTE SAID AGREEMENT; AUTHORIZING <br />THE CITY MANAGER TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THIS RESOLUION; PROVIDING FOR AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the City is in need of a contractor to design and construct a fabric canopy <br />structure at Heritage Park for the safety and welfare of our residents and tourists alike who utilize the <br />Park; and <br /> <br />WHEREAS, the City issued and advertised Request for Proposals (RFP) No. 11-04-02, for <br />the design and construction of a canopy structure at Heritage Park, for which one response was <br />received; and <br /> <br />WHEREAS, Castle USA Corporation is willing and able to provide the services; and <br /> <br />WHEREAS, the City wishes to enter into an Agreement with Castle USA Corporation, in an <br />amount not to exceed One Hundred Eight Thousand Two Hundred Thirty-Six Dollars ($108,236.00), <br />and a contingency in an amount not to exceed Twenty Thousand Dollars ($20,000.00), for the design <br />and construction of a fabric canopy structure at Heritage Park, attached hereto as Exhibit "A", based <br />on the terms and conditions listed in the bid response, attached hereto as Attachment "A", for a total <br />contract amount of One Hundred Twenty-Eight Thousand Two Hundred Thirty-Six Dollars <br />($128,236.00). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of Recitals. The recitals set forth in this resolution are incorporated <br />herein by reference as if fully set forth herein. <br /> <br />Section 2. Award of Bid and Approval of Agreement. The City Commission hereby awards Bid <br />No. 11-04-02 to and enters into an agreement with Castle USA Corporation for the design and <br />construction of a fabric canopy structure at Heritage Park, in a total amount not to exceed One <br />Hundred Twenty-Eight Thousand Two Hundred Thirty-Six Dollars ($128,236.00), attached hereto as <br /> <br />R2011- Castle USA Corp Agml Canopy at Heritage Pk (Bid 11-04-02) <br /> <br />Page I on <br />
