RESOLUTION NO. 2011-_' '1 '-~ t..o A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING TEMPORARY HOURS OF OPERA TION FOR THE SKATEBOARD P ARK LOCATED AT TOWN CENTER PARK; PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING DIRECTIVE TO THE CITY CLERK; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 14,2010, the City Commission passed and adopted Resolution No. 2010-1619, awarding RFP No. 10-08-03 to and entering into an Agreement with Sugars Drop Shop for concessionaire services for the Skateboard Park located at Town Center Park; and WHEREAS, the concessionaire services agreement with Sugars Drop Shop provides for, among other things, maintenance and operation of the concession area within the standards established by the City; and WHEREAS, the City desires to reduce the hours of operations for the Skateboard Park, as a temporary measure, while the City continues to work with its expert consultant to find a permanent noise mitigation solution. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approving Temporary Hours of Operation for the Skateboard Park located at Town Center Park. The City Commission hereby declares its desire, subject to future permanent mitigation measures, to reduce the summer hours of operations at the Skateboard Park until the beginning of the school year on August 22, 2011. Commencing upon the effective date of this Resolution, and continuing up to and including August 22, 2011, the new hours of operations at the Skateboard Park shall be Sunday through Friday from 1 :00 p.m. to 7:00 p.m. and on Saturday from 11 :00 a.m. to 7:00 p.m. However, on Saturdays from 11 :00 a.m. to 1 :00 p.m the use of the Skateboard Park shall be restricted to pre-teen instruction only. Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Directive to the City Clerk. The City Commission hereby directs the City Clerk to transmit a copy of this Resolution to Sugars Drop Shop, the operator of the concessionaire services for the Skateboard Park located at Town Center Park. Section 4. Effective Date. This Resolution shall become effective upon adoption. PASSED AND ADOPTED this 15th day of June 2011.
