H. "Open house" event signs: Such signs are permissible and shall be located at the front entrance of a single family residential neighborhood subiect to the approval of the City Manager or his designee. Such signs shall be permitted within twenty four (24) hours of the open house event and shall be removed no later than twenty four (24) hours after the open house event. This twenty four (24) hour time limitation may be extended to no more than forty eight (48) hours based on good cause shown and approval by the City Manager or his designee. This Ordinance shall not apply to multi-family buildings or condominium associations. The applicant for the open house event sign shall be required to apply for a temporary sign permit from the City Manager or his designee each year, in the amount of twenty five dollars ($25.00) per year. Such signs shall not be permitted if this registration requirement is not met. Any person violating any of the provisions of this subsection shall be subiect to a daily penalty in the amount of two hundred fifty dollars ($250.00) per day for each continuing day of non-compliance. For the first repeat violation of this subsection, the applicant shall be prohibited from registering for an open house event sign for one year. For the second repeat violation of this subsection, the applicant shall be permanently banned from applying for an open house event sign. Section 2. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the inval idity of any part. Section 3. Inclusion in the Code. it is the intention of the Commission, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the code of the City of Sunny lsles Beach, Florida; and that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 4. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 5. Effective Date. This Ordinance shall be effective ten (10) days after adoption on second reading. PASSED and ADOPTED on first reading the 2 \St-day of ~\l '-~ 2011.
