RESOLUTION NO. 2011- 1'1l:/8 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, EXTENDING THE BUILDING PERMIT ISSUED TO MANSIANA OCEAN RESIDENCES, LLC.; PROVIDING THE CITY MANAGER AND THE CITY ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Pursuant to a Letter Agreement dated August 26, 2009, Mansiana Ocean Residences, LLC ("Mansi ana") agreed to pay $607,585.16 to the City for outstanding building permit fees no later than August 26, 2011; and WHEREAS, in accordance with an Agreed Court Order issued in a foreclosure action against Mansiana, Mercantil Commerce Bank, N.A. ("Commerce Bank") provided the City with the aforementioned payment on behalf of Mansiana; and WHEREAS, the Agreed Court Order requires the City to extend the building permit issued to Mansiana for a period ending on August 28, 2013; and WHEREAS, pursuant to Senate Bill 1752, the City Commission wishes to extend the building permit issued to Mansiana. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Extending the Building Permit. The City Commission hereby extends the building permit issued to Mansiana in accordance with time frame set forth in Agreed Court Order, attached hereto as Exhibit "A" provided that Mansiana or Commerce Bank complies with all the conditions enumerated in the Agreed Court Order. Section 2. Authorization of City Manager and the City Attorney. The City Manager and the City Attorney are hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Effective Date. This Resolution shall become effective upon adoption. PASSED AND ADOPTED this I~day of September, 2011.
