<br />RESOLUTION NO. 2011- ~ <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, RESCINDING <br />RESOLUTION NO. 2011-1777 ADOPTED ON SEPTEMBER <br />15, 2011; AUTHORIZING THE CHIEF OF POLICE, IN <br />ACCORDANCE WITH THE COMPREHENSIVE CRIME <br />CONTROL ACT OF 1984 TO EXPEND UP TO ONE <br />HUNDRED FIFTEEN THOUSAND NINE HUNDRED <br />EIGHTY-FOUR DOLLARS AND FORTY-NINE CENTS <br />($115,984.49) FROM THE FEDERAL FORFEITURE (DOJ) <br />FUNDS FOR THE PURCHASE OF MISCELLANEOUS LAW <br />ENFORCEMENT EQUIPMENT AND TECHNOLOGY; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City <br />and its Police Department are authorized to expend forfeiture funds from the established Department <br />of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to <br />enhance law enforcement purposes; and <br /> <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, upon the <br />request of the Chief of Police to the governing body of a municipality, federally forfeited funds may <br />be expended if accompanied by written certification that the request complies with the provisions of <br />the Comprehensive Crime Control Act of 1984; and <br /> <br />WHEREAS, on September 15, 2011 via Resolution No. 2011-1777 the City Commission <br />authorized the Chief of Police to expend up to One Hundred Thirteen Thousand Eight Hundred <br />Fourteen Dollars and Ninety-Nine Cents ($113,814.99) for the purchase of miscellaneous law <br />enforcement equipment and technology, including a purchase of laptop computers from L.A. <br />Computer based on them providing the most responsive bid, after which time the L.A. Computer <br />Company notified the City that it was unable to honor the price it provided the City;. and <br /> <br />WHEREAS, the Chief of Police has now submitted an amended request to cover the <br />amended amount of the purchase oflaptop computers from Apple Enterprise, for the expenditure of <br />up to One Hundred Fifteen Thousand Nine Hundred Eighty-Four Dollars and Forty-Nine Cents <br />($115,984.49) in federally forfeited funds in compliance with the aforementioned. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Rescind Resolution No. 2011-1779. Resolution No. 2011-1777 approving the <br />expenditure of forfeiture funds is hereby rescinded. <br /> <br />Section 2. Expenditure of Federally Forfeited Monies. Based on the attached Certification, the <br />Chief of Police is hereby authorized to spend up to One Hundred Fifteen Thousand Nine Hundred <br />Eighty-Four Dollars and Forty-Nine Cents ($115,984.49) from the established Department of Justice <br />(DOJ) Federal Forfeitures Account for the purchase of miscellaneous law enforcement equipment <br />and technology. <br /> <br />R2011- Repeal R2011-1777 and Approve Police Fed Forfeiture (DOJ) Expenditure <br /> <br />Page I of2 <br />
