ORDINANCE 2011-3J~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 14-16 OF THE CITY CODE TO AUTHORIZE CODE ENFORCEMENT LIEN SEARCH FEES; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CITY CODE; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, on May 28, 1998, the City Commission of the City of Sunny Isles Beach passed and adopted Resolution No. 98-51, authorizing code enforcement lien search fees; and WHEREAS, Resolution No. 98-51 provided authority for the City's Community Development Department to assess fees ranging from $25.00 to $50.00 when verifying the existence of code enforcement liens; and WHEREAS, on October 16, 2001, the City Commission passed and adopted Ordinance No. 2001-141 establishing Chapter 14 of the City Code pertaining to code enforcement; and WHEREAS, Chapter 14 of the City Code contains a schedule of civil penalties and miscellaneous fee schedule at the end of the chapter, but does not specifically address the issue of code enforcement lien search fees; and WHEREAS, the City Commission desires to amend Chapter 14 of the City Code to specifically authorize the City to impose code enforcement lien search fees. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and confirmed as being true and the same are hereby made part of this Ordinance. Section 2. Amendment. Chapter 14 of the City Code is hereby amended as shown, with additions shown in underline and deletions shown in strikethrough. ~ 14-16. Schedule of civil penalties..- and miscellaneous fees schedule. C. The City is authorized to impose the following fees when verifying the existence of code enforcement liens on property located in the City. A company or individual seeking to verify the existence of code enforcement liens shall pay a fee of $100.00 when a turnaround time of less than 24 hours is requested. When the requesting party seeks a turnaround time within 7 days, the requesting party shall pay a fee of $75.00.
