<br />Summary Minutes: Regular City Commission Meeting <br /> <br />July 22,2004 <br /> <br />City of Sunny Isles Beach, Rorida <br /> <br />Action: City Clerk Hines read the title, and Mayor Ede1cup reported. <br /> <br />Public Speakers: none <br /> <br />Commissioner Thaler moved and Commissioner Brezin seconded the motion. LPA <br />Resolution No. 2004-20 was adopted by a voice vote of 5-0 in favor. <br /> <br />9B.2 An Ordinance of the City of Sunny Isles Beach, Florida, Amending Section 265-58 (I) of <br />the Land Development Regulations Relating to Temporary Construction Fencing; <br />Establishing General Standards for the Installation of Temporary Construction Fences; <br />Prohibiting Certain Fences; Making this Ordinance Retroactive 90 Days and Allowing <br />Compliance; Providing for a Repealer; Providing for Inclusion in the Code; Providing for <br />Severability; and Providing for an Effective Date. <br />(First Reading 7/8/04) <br /> <br />Action: City Clerk Hines read the title, and City Attorney Dannheisser reported. <br /> <br />Mayor Edelcup noted that the wind blows through the fences on the east side of Collins <br />Avenue destroying the plants in the medians, and this Ordinance is to retroactively allow <br />property owners who have already erected a construction fence that does not comply with <br />this ordinance, to have 90-days from the passage of this ordinance to come into <br />compliance. Commissioner Iglesias said if the fence meets the South Florida Building <br />Code, he thinks we should take it from here on, and he understands that there are some <br />landscaping issues but it is unfair to make a person go retroactive if the fence meets the <br />South Florida Building Code. Mayor Ede1cup said that the problem is that the fence on <br />the east side is not taking care of or protecting our landscaping, and in his opinion we <br />should just make it retroactive and give the people 90-days to do it, and he hasn't heard <br />any complaints that this would be a hardship. <br /> <br />Public Speakers: none <br /> <br />Commissioner Thaler moved and Vice Mayor Goodman seconded a motion to adopt the <br />ordinance.
