Summary Minutes: Regular City Commission Meeting December 8, 2005

City of Sunny Isles Beach, Florida

deems appropriate; and, 2) accept their offer of additional beach access easements ofJ-feet on
either side of the property to coordinate with those of Jade and Ocean 4, and to accept a
dedication of those by easement to the City.

Vice Mayor Thaler was very happy with the corrections that have been made and laid out to
them, and he is sure the school children would appreciate the $1 Million that they are giving
to the City for the projected school here, and he still had two points to make regarding the
parking area. He said he would like the wording, ifit can be changed in the condo documents,
to "valet parking for the lifetime of the building"; and secondly, he would like a "dedicated
generator" to this area so in case of emergencies this dedicated generator will operate without
electricity. Mr. Schulman said that they have no problem with the 24/7 valet parking, and
even stronger than the condominium documents is a condition of this Commission's approval
that says that and suggested that it be added to the condition, and Vice Mayor Thaler asked
staff to do that. Mr. Schulman said that this building will have an emergency generator, the
parking facilities will be keyed into the emergency generator so that they will operate, and
noted that when the electric goes off on these facilities, there is one thing that works on a
above-car tandem parking, you press a button, and the car that is above, by gravity, goes down
slowly.

Commissioner Goodman asked who is going to be responsible to take care of the lifts in the
beach accesses, and Mr. Schulman said it is the responsibility of the condo association, and
said that these facilities are also used by the owners. Commissioner Goodman asked what
type of lift is it and how high is it going to go up, and Mr. Karp said one floor and hydraulic
elevator.

Mayor Edelcup said that they appreciate the $1 Million offer for the school and that they will
earmark it to be used specifically for a school whether it be the public school that they
anticipate or if that would fail, then for a Charter School. Commissioner Brezin asked the
developer for a shower, drinking fountain, and foot wash to be placed in the beach access, and
Mr. Schulman said that they would agree to that.

Commissioner Brezin moved and Vice Mayor Thaler seconded a motion for approval,
subject to staff conditions, and to all of the above mentioned-conditions: $1 Million for
the school; additional beach access easements of 3-feet on either side of the property;
24/7 valet parking for the lifetime of the building; dedicated generator with the parking
facilities keyed into the generator; a shower, drinking fountain, and foot wash to be
placed in the beach access. Resolution No. 05-Z-99 was approved by a roll call vote of
5-0 in favor.
V ote: Commissioner Brezin yes
Commissioner Goodman yes
Commissioner Iglesias ~
Vice Mayor Thaler yes
Mayor Edelcup yes

[City Clerk's Note: lOB was heard after this item)

4
