Summary Minutes: Regular City Commission Meeting October 19, 2006

City of Sunny Isles Beach, Florida

you would have this design and then at the top you would have to come in and create a box at
the top and it really compromised the entire design in concept ofthis project, and so they have
asked for the ability on those top floors to go straight up as opposed to creating a cap on top of
the building.

Commissioner Iglesias noted that the variances are nothing major and he has no problems
with them. Vice Mayor Brezin asked what the width is of the walkway and Kobi Karp said
10-feet, 6-feet is required. Vice Mayor Brezin asked if it is fenced in with reference to the
City of Sunny Isles Beach Code, and Mr. Karp said yes, what is required by Shoreline is the
ballard and chain design which goes all along the top of the seawall.

Commissioner Goodman asked about retail and tandem parking and if there is 100% valet
parking, and Mr. Helfman said yes, there will be 100% valet service 24-hours a day at this
building, a resident does not have to use valet parking, and there will be no tandem spaces in
front of a resident's space. He said it is not designed to have tandem spaces that would block
a driver's spot, if it is tandem, it is going to be used as part of a valet operation only.
Commissioner Goodman said he is not concerned about the homeowners but he is concerned
about the public going to the spa or restaurant or marina. City Attorney Ottinot noted on page
50, item 5, last sentence "The provision of24-hour valet parking services for owners and their
guests shall be included in the Declaration." Mayor Edelcup said that some people can drive
up and self park so you will have the choice of either valet or self parking.

Commissioner Goodman asked if the boardwalk will eventually go out to Collins Avenue, and
Mr. Helfman said that is what they would like, that they have designed their boardwalk to it
and it will be continuous through the W ASA site and to the St. Tropez site.

Commissioner Thaler asked about the roads to get in, it is very narrow, are we planning
anything to enhance those roads to make it easier so we don't have a backup on Sunny Isles
Beach Boulevard, and Commissioner Iglesias said they can't be touched because they belong
to DOT. Commissioner Iglesias said you have main girders and the columns that hold the
bridge, so the setback can't be moved. Commissioner Thaler said somehow it should be
enhanced or widen so that we are not going to wind up having a backup if a number of trucks
have to go in there to deliver to the restaurants and/or to the people, this will be a problem.
Kobi Karp said it really is the front entrance to the building because each and everyone of
their guests will come underneath the bridge, so they do have a vested interest in improving it
whether it is working with DOT, or with W ASA and landscaping it and opening up the views
to the water or if in the future the area could become a park it would be wonderful because
that is why they have left a setback and a fire access and in the plans they have a restaurant on
the west side which opens up with a beautiful outside terrace so they would like to improve
and glorify that area and will continue to work with DOT on that. Commissioner Thaler
asked if there will be additional lighting put in to make it easier to maneuver, and Mr. Karp
said he can't speak on behalf of DOT but he said they are working very strongly with them
and they will come up with a happy medium for both the City and them. Mayor Edelcup said
for the rest of that area that the City is already planning with Fortune to develop that area
underneath into a park-like surrounding so that will also help enhance this area and then what
is left open are the two properties that are still available to the west of them as to what will
eventually get developed there and it may dictate what that entranceway looks like.

5
