<br />Summary Minutes: Regular City Commission Meeting January 17,2008 <br /> <br />City of Sunny Isles Beach, Florida <br /> <br />that at the same time they will notify the condos and the individuals as to when the work is <br />going to start, and relay what you just said. <br /> <br />City Manager Szerlag said for information, our protocol on Sunny Isles Beach for all <br />construction projects is to have a neighborhood meeting with residents that are effected and <br />part of that meeting includes a MOT, or a Maintenance of Traffic and we require if possible <br />all roads to be open at all times on at least one lane, and every home has access, every curb <br />cut, but that is all laid out to the property and condo owners prior to construction. <br /> <br />Vice Mayor Thaler said you will probably only have about 5% of the people showing up at <br />these meetings and that is why he is asking for notification to be sent out. <br /> <br />Commissioner Goodman moved and Vice Mayor Thaler seconded a motion to approve the <br />resolution. Resolution No. 2008-1210 was adopted by a voice vote of 5-0 in favor. <br /> <br />100. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Ratifying <br />the Approval to Amend Resolution No. 2007-1168 to Extend the Time for Payment of <br />Transfer of Development Rights ("TDRs") by Mansiana Ocean Residences, LLC. <br />(Commonly Known as the Solis Development Project); Approving the Second <br />Amendment to Promissory Note, Attached Hereto as Exhibit "A"; Providing the City <br />Manager and City Attorney with the Authority to Do All Things Necessary to Effectuate this <br />Resolution; Providing for an Effective Date. <br /> <br />Action: [City Clerk's Note: An amended Exhibit "A" was distributed prior to the meeting.} <br />City Clerk Hines read the title, and City Manager Szerlag reported that he has an amended <br />request on the extension from Danny Tantleff of Solis, that he would like to have the <br />extension go to December 31, 2008. He said the conditions that he outlined in his January <br />17,2008 letter are essentially the same, it will be 7.5% payment on the unpaid balance, the <br />difference will be quarterly payments made on the interest to the City of Sunny Isles Beach, <br />and this will enable the contractor to continue with his permitting and construction to keep <br />his crew on site and hopefully reach appropriate financing in a more expedient fashion. <br /> <br />Public Speakers: none <br /> <br />Commissioner Scholl asked what our mechanism is if payments are not met, and City <br />Manager Szerlag responded that we would issue a stop work order. City Attorney Ottinot <br />said that this is a promissory note and if they fail to comply we can go to court and enforce <br />that promissory note. <br /> <br />Vice Mayor Thaler moved and Commissioner Scholl seconded a motion to approve the <br />resolution, as amended. Resolution No. 2008-1211 was adopted by a voice vote of 5-0 in <br />favor. <br /> <br />12 <br />
