<br />Summary Minutes: Regular City Commission Meeting February 21, 2008 <br /> <br />City of Sunny Isles Beach, Florida <br /> <br />13,143 square feet and seven (7) dwelling units from the City's Transfer Development <br />Rights Bank). <br /> <br />i. Development Review Report. <br />ii. Report from Applicant. <br />iii. Public Hearing. <br />iv. Commission Action. <br /> <br />(Deferred from 01/17/08 - Applicant is requesting Deferral to March 20,2008) <br /> <br />Protests 0 <br /> <br />Waivers <br /> <br />o <br /> <br />Ex Parte <br /> <br />o <br /> <br />Action: Community Development Director Robert Solera said that the Applicant's attorney <br />requested that this item be deferred to the March 20, 2008 Commission Meeting. <br /> <br />Public Speakers: Estrellita Sibila <br /> <br />Estrellita Sibila on behalf of Weiss Serota Helfman Pastoriza Cole & Boniske, P.L., stated <br />that they took over this matter recently and Lynn Dannheisser who is handling it is out of <br />town, and therefore they are asking for deferral of this and the companion item lOA dealing <br />with the TDRs. Mayor Edelcup said that this is the second time that this item has been <br />requested for deferral, and if we defer it this time, this will be the last time, and he asked if she <br />will be ready for the March meeting, and Ms. Sibila responded that they will be ready. <br /> <br />Commissioner Goodman moved and Commissioner Brezin seconded a motion to defer this <br />item and Item lOA to the March 20, 2008 Commission meeting, and was approved by <br />voice vote of 4-0-1 (Vice Mayor Thaler absent) in favor. <br /> <br />7. ORDINANCES FOR FIRST READING <br /> <br />7 A. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida, Creating <br />and Adopting a Code Section Entitled "Water Restrictions", Providing for Purpose and <br />Intent; Providing for Definitions; Providing for Applicability; Providing for Water Shortage <br />Plan; Providing for Declaration of Water Shortage; Providing for Enforcement and Penalties; <br />Providing for Severability; Providing for Repealer; Providing for Codification; Providing for <br />an Effective Date. <br /> <br />Action: City Clerk Hines read the title, and Community Development Director Robert Solera <br />reported, noting that the South Florida Water Management District imposed Phase Level III <br />restrictions in South Florida, effective January 15, 2008, no exceptions for Government <br />Facilities, less than five (5) acres can choose one 4-hour window consisting of 4:00 a.m. to <br />8:00 a.m. or 4:00 p.m. to 8:00 p.m. with odd addresses on Mondays and even addresses on <br />Thursdays. He noted that the South Florida Water Management District indicated that Phase <br />Levels II and III do not require a warning, but as is customary in Sunny Isles Beach, we try to <br />inform everyone first, and so we will issue a warning first as a first offense and after that they <br />will continue with a corresponding fine. <br /> <br />Public Speakers: none <br /> <br />Mayor Edelcup asked if the declaration as to which phase we are in, will always be done by <br />the South Florida Water Management District, and our actions will be governed by their <br />3 <br />
