An Ordinance ofthe City Commission of the City of Sunny Isles Beach, Florida, Amending <br />Section 33-2 of the Code of Ordinances of the City of Sunny Isles Beach Relating to <br />Lobbyist Registration and Fees; Providing for Severability; Providing for Repealer; <br />Providing for Inclusion in the Code; Providing for an Effective Date. <br /> <br />Action: City Clerk Hines read the title, and City Attorney Ottinot reported that the purpose of <br />this proposal is to be less bureaucratic. If a person hires a Lobbyist to represent him or her <br />before the Commission or staff, that person does not need to register. However, if a person <br />does not hire a Lobbyist, that person will be required to register. This is a clarification of <br />what we have been doing over the years. <br /> <br />Public Speakers: none <br /> <br />Vice Mayor Thaler moved and Commissioner Aelion seconded a motion to approve the <br />proposed ordinance on first reading. The motion was approved by a roll call vote of 5- <br />o in favor. An Ordinance ofthe City Commission of the City of Sunny Isles Beach, Florida, Amending <br />Chapter 265 "Zoning" Including Section 265-37 "Town Center Zoning District" to Provide <br />for Transferring Building Heights within the Sunny Isles Beach Boulevard South Edge Street <br />Type within the Town Center District; and Including Amending Section 265-35 "Mixed Use- <br />Resort District (MU-R)" to Modify Floor Area Ratio Bonuses, Establish Federal Aviation <br />Administration Restrictions as Height Limitations Therein, Adiust Interior Side Setbacks for <br />Parcels 200 Feet or More in Width, and to Permit Connecting Bridges Between Certain <br />Adjacent Properties; and Including Amending Section 265-23 "Transfers of Development <br />Rights" to Establish Federal Aviation Administration Restrictions as the Height Limitation <br />for Receiving Sites; Providing for Zoning in Progress; Providing for Repealer; Providing for <br />Severability; Providing for Inclusion in the Code; Providing for an Effective Date and <br />Applicability. <br /> <br />Action: [City Clerk's Note: A revised Ordinance was distributed prior to the meeting. See <br />Item 4A for additional action.] City Clerk Hines read the title, and City Attorney Ottinot <br />reported noting that a revised Ordinance was distributed. The purpose of this proposal is to <br />revise several sections of the City's Zoning Code to provide development incentive for new <br />projects. In Section 265-35 MUR District, under the current City Code the base intensity <br />generally known as the Floor Area Ratio CF AR) can be increased through a Bonus System in <br />the City Code. Under the proposed Ordinance the maximum FAR would increase from 4.0 <br />to 4.6 with the use of Bonuses. The proposed Ordinance increases the Streetscape Bonus to <br />provide more funding for decorative sidewalks, similar to what we have on the west side of <br />Collins Avenue, we will be able to put those sidewalks on the east side. We will also have <br />more funding for underground utilities. We also will create a new Bonus called the <br />"Educational and Cultural Bonus" to provide funding for school and cultural related capital <br /> <br />3 <br />
