<br /> <br />AGREEMENT BETWEEN THE CITY OF SUNNY ISLES <br />BEACH AND BETTOLI TRADING CORPORATION <br />D/B/A BETTOLI VENDING <br />CONTRACT NO. Cll12-009 <br /> <br />THIS AGREEMENT (hereinafter referred to as the "Agreement") is made in duplicate, <br />this i &"tjI day of "4-(,SVvt~B"~ 2010, by and between the CITY OF SUNNY ISLES <br />BEACH," Florida, (hereinafter referred to as "City"), and BETTOLI TRADING <br />CORPORATION D/B/A BETTOLI VENDING a corporation authorized to do business in the <br />State of Florida (hereinafter referred to as "Contractor") whose Federal I.D. # is <br />(a'S: - lOS"IOGS" <br /> <br />RECITALS <br /> <br />WHEREAS, the City is in need of a vending machine company to provide City wide <br />healthy organic vending machine services and install new machines at locations such as Heritage <br />Park, Golden Shores Park, Senator Gwen Margolis Park and major beach accesses ("Services"); <br />and <br /> <br />WHEREAS, the City issued Request for Proposal No. 11-11-04 for Organic Vending <br />Machines and the Contractor submitted a response thereto; and <br /> <br />WHEREAS, Contractor is a certified and insured company with the necessary <br />experience to provide the desired Services; and <br /> <br />WHEREAS, the City wishes to contract with Contractor to provide the desired Services <br />with the City wherein the City shall receive 20% commission on sales which is determined based <br />on the vending price to the public, as more particularly described in Attachment "A". <br /> <br />NOW THEREFORE, in consideration of the promises and the mutual covenants herein <br />name, the parties agree as follows: <br /> <br />1. RECITALS. The Recitals set forth above are hereby incorporated into this agreement <br />and made a part hereof for reference. <br /> <br />2. SERVICES. Contractor shall provide to the City the Services as more particularly <br />described in Attachment "A" attached hereto and made a part hereof. <br /> <br />3. TERM. The term of this Agreement shall commence upon the first calendar day of the <br />month succeeding approval of this Agreement by the City Commission, unless otherwise <br />stipulated in the Notice of Award letter distributed by the City's Purchasing Agent, and shall <br />terminate no later than 1 (one) year thereafter, subject to the City's ability to terminate earlier in <br />accordance with Section 10 of this Agreement. <br /> <br />Cll12-009 VENDING MACHINES AGREEMENT <br /> <br />Page 1 of8 <br />
