All requests must be submitted in a manner that clearly <br />identi fies the drawing and/or specification section where clarification or interpretation is <br />being requested. <br /> <br />ARTICLE 8. FIELD DIRECTIVES <br /> <br />The City or its designee may at times issue Field Directives to the Contractor based <br />on visits to the Project site. Such Field Directives shall be issued in writing and the <br />Contractor shall be required to comply with such directive. Where the Contractor <br />believes that the directive is outside the scope of the Work, the Contractor shall, <br />within 48 hours, notify the City or its designec that the Field Directive is outside the <br />scope of the Work. At that time the Field Directive may be rescinded or the Contractor <br />may be required to submit a request for a Change Order proposal. Where the Contractor <br />is notified of the position that the Field Directive is within the scope and the Contractor <br />disagrees, the Contractor shall notify the City or its designee that the Contractor <br />reserves the right to make a claim for the time and monies based on the Field <br />Directive. At no time shall the Contractor refuse to comply with the directive. <br />Failure to comply with the directive may result in a dctermination that the Contractor is <br />in default of the Agreement. <br /> <br />ARTICLE 9. CHANGE ORDERS <br /> <br />9.1 Changes in the quantity or character of the Construction Work of the Project which are <br />not properly the subject of Field Directives shall be authorized only by Change Orders <br />approved in advance and issued in accordance with the provisions of this Contract. <br /> <br />9.2 All changes to the Work or the construction Schedule must be pre-approved in writing <br />by the City Manager in accordance with the value of the Change Order or the calculated <br />value of the time extension. <br /> <br />9.3 In the event satisfactory adjustment cannot be reached for any item requiring a <br />change in the Contract Amount, the City reserves the right at its sole option to either <br />terminate the Agreement as it applies to the items in question and make such arrangements <br />as may be deemed necessary to complete the disputed work; or may submit the matter in <br />dispute as set forth in the dispute resolution procedures set forth in this Agreement. <br /> <br />9.4 On approval of any changc increasing the Contract amount, Contractor shall ensure that <br />the Bonds are increased accordingly. <br /> <br />ARTICLE 10. SCOPE OF WORK MODIFICATION PROCEDURES <br /> <br />10.1 OWNER INITIATED MODIFICATIONS <br /> <br />The City or its designee will issue a detailed description of proposed changes in the Work <br />that may require an adjustment(s) to the Contract Amount or Contract Time. If <br />necessary, the description will include supplemental or revised drawings and <br />specifications.
