Summary Minutes: Regular City Commission Meeting December 15. 20 II

11.
llA.

City of Sunny Isles Beach, Florida

so it had to be sent back to the factory in Arizona for those fasteners. It is under warranty
and so we are not paying extra for it, he has not heard back from them yet.

Commissioner Scholl said he believes there are three (3) choices: 1) we close the Park; 2) we
keep the Park open; or 3) we find a permanent solution, and we fund it and deal with it. He
has always advocated to finding a permanent solution, funding it, and dealing with it. He
doesn't know what the numbers are, we never got any kind of reasonable scope of what those
solutions are. He still advocates whether we spend the $50,000 or not, staff scoping a
solution and putting something in front of us so we know what we are voting on. Again, he
thinks it is a significant amenity for our children, we are spending $4 Million to expand our
school which means more kids will come into this community and more kids will use that
facility. He thinks we are being shortsighted by not dealing with the problem head-on.

Mayor Ede1cup said that we did deal with the problem, we had some engineering reports
made and the only solution was to enclose the Park which would be the only way to sound-
proof it. There were no other solutions that were presented to us by the engineers other than
that. He thinks it is unrealistic to assume that it is not going to be a multi-figure dollar cost.
He recognizes Commissioner Scholl's position which is you may be willing to spend that
money, he doesn't think he would have the votes on this Board to spend that money, and that
is why he is saying let's get this over with one way or the other to a straight up or down vote
and make the decision tonight so we can move forward. Commissioner Scholl said his point
is that we don't have any numbers before us. Commissioner Aelion said in the future can a
resident come and raise an issue, and Mayor Ede1cup said let's go back to clarify that
question, the Code was to cover construction noise. City Attorney Ottinot said general noise
of the City, and obviously we have not applied it to Park noise, if you did, most of the Parks
would exceed that decibel level especially when you have activities in the Park, and Mayor
Edelcup said yes like games or basketball where you would exceed that decibel level.

Commissioner Gatto moved and Vice Mayor Thaler seconded a motion to approve the
resolution to close the Skateboard Park at Town Center Park. Resolution No. 2011-
1829 was adopted by a roll call vote of 2-3 [Commissioner Aelion, Vice Mayor Thaler
and Mayor Edelcup against] the motion failed to close the Park.
Vote: Commissioner Aelion no
Commissioner Gatto ~
Commissioner Scholl ~
Vice Mayor Thaler no
Mayor Ede1cup no

MOTIONS

Add-On: Call for a Motion to Confirm the Appointment of Fang Oliver, Vice President
and the 2012 Designated President ofthe Taiwanese Chamber of Commerce of Miami, and
Director of the Taiwanese Chamber of Commerce of North America, as the Sunny Isles
Beach International Ambassador to Asia. (Vice Mayor Thaler)
[City Clerk's Note: This motion moved to Item J OQ.]

14
