<br />that the total of appropriations or the fund is not changed. A transfer considered by <br />the Commission must be approved by majority. <br /> <br />B. Other amendments. If a budget amendment is required for a purpose not specifically <br />authorized in paragraph "A" above, the budget amendment must be adopted by <br />ordinance. resolution of the City Commission.; provided, hov/ever, up to 1 % of the <br />contingency reserve fund may be transferred to any departmental budget by approval <br />of a duly enacted resolution. <br /> <br />C. TRIM Certification. Prior to the execution of the TRIM notice form commonly called <br />DR -420, the City Manager or Finance Director shall request approval by Resolution <br />the proposed operating millage rate for the fiscal year. <br /> <br />S 1 0-2 Grants and gifts. <br /> <br />S 1 0-3 Postaudit provided. <br /> <br />& 1 0-4 Emergency Fund Balance Reserve. <br /> <br />The City shall maintain a minimum emergency reserve fund balance in the General Fund <br />of at least $10 Million Dollars. The "Emergency Reserve Fund" shall be limited to the <br />following purposes: <br /> <br />A. To provide required emergency funding as a result of a declared emergency. <br /> <br />B. To provide required funding for an unanticipated but urgent threatening of the public <br />health, safety, and welfare of the City of Sunny Isles Beach. <br /> <br />C. The Emergency Reserve Fund shall only be utilized by resolution of the City <br />Commission for the reasons stated in subparagraphs "A" and "B" by a super-maiority <br />vote of the City Commission. For purposes of this Section, super-maiority means a 4- <br />1 vote of the City Commission. If the Emergency Reserve Fund is increased beyond <br />the minimum $10 Million Dollars amount, the restrictions stated in this section shall <br />not apply for use of reserve funds above the $10 Million Dollars minimum. <br /> <br />Section 3. Severability. The provisions of this Ordinance are declared to be severable and if <br />any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid <br />or unconstitutional, such decision shall not affect the validity of the remaining sections, <br />sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the <br />legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. <br /> <br />Section 4. Inclusion in the Code.
