<br />RESOLUTION NO. 2012- l'dlon <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, <br />AUTHORIZING THE CITY MANAGER TO WAIVE THE <br />FORMAL COMPETITIVE BIDDING PROCEDURES <br />PURSUANT TO SECTION 62-12 OF THE CITY CODE TO <br />NEGOTIATE AGREEMENTS FOR THE PREPARATION <br />AND LANDSCAPING OF THE INTRACOASTAL PARKS; <br />AUTHORIZING THE CITY MANAGER TO EXPEND AN <br />AMOUNT NOT TO EXCEED SEVENTY THOUSAND <br />DOLLARS ($70,000.00), AND TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THIS RESOLUTION; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, on January 19, 2012 via Ordinance No. 2012-378, the City Commission <br />authorized an amendment to the City's Budget for the 2011/2012 Fiscal Year Capital Projects <br />Funds to increase the Intracoastal Parks- account to complete the landscaping project at the <br />Intracoastal Parks at 16700 Collins Avenue; and <br /> <br />WHEREAS, pursuant to Section 62-12 of the City's Procurement Code, the City <br />Manager has determined that it is in the best interest of the City to waive its formal competitive <br />bidding procedures due to time constraints and the urgent nature of the Intracoastal Parks project; <br />and <br /> <br />WHEREAS, the City Manager has determined that there is a need to retain a contractor <br />to complete the landscaping due to the current deteriorating condition of the Intracoastal Parks <br />and requests permission to expend funds, in an amount not to exceed Seventy Thousand Dollars <br />($70,000.00), to complete the landscaping of the Intracoastal Parks project. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Waiver of Competitive Bidding Requirements. The Competitive Bidding <br />Requirements of Chapter 62 of the City Code are hereby waived for the limited purpose of <br />retaining a contractor to landscape Intracoastal Park. <br /> <br />Section 2. Authorization of City Manager. The City Manager and/or his designee are hereby <br />authorized to expend an amount not to exceed Seventy Thousand Dollars ($70,000.00), for the <br />completion of the landscaping of Intracoastal Parks. <br /> <br />Section 3. Further Authorization of City Manager. Provided the City Attorney approves all <br />contracts as to form and legal sufficiency, the City Manager is further authorized to execute said <br />contracts and to do all things necessary to effectuate this Resolution. <br /> <br />Section 4. <br /> <br />Effective Date.
