RESOLUTION NO. 2012 - ]$S3 <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY <br /> ISLES BEACH,FLORIDA,APPROVING THE INITIAL SCHEMATIC DESIGN <br /> FOR GATEWAY PARK AND PARKING GARAGE AND APPROVING A <br /> SECOND AMENDMENT TO DESIGN-BUILD AGREEMENT BETWEEN THE <br /> CITY OF SUNNY ISLES BEACH AND 4M INVESTORS, LLC., FOR A PARK <br /> AND PARKING GARAGE, ATTACHED HERETO AS EXHIBIT "B"; <br /> FURTHER APPROVING A TAX EXEMPTION AGREEMENT;AUTHORIZING <br /> THE MAYOR TO EXECUTE SAID SECOND AMENDMENT TO <br /> AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS <br /> NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN <br /> EFFECTIVE DATE. <br /> WHEREAS,on July 21, 2011, via Resolution No. 2011-1735,the City Commission entered <br /> into a Design-Build Agreement with 4M Investors, LLC. (Contractor) for certain parcels of real <br /> property located in the City which the City owns and upon which it intends to have constructed site <br /> improvements consisting of a Park and Parking Garage for Gateway Park located in the City of <br /> Sunny Isles Beach; and <br /> WHEREAS,the City desires to enter into a Second Amendment to the Agreement with 4M <br /> Investors; LLC to include additional amenities to the project consisting of the total and complete <br /> design and construction of a park and a three hundred and eight (308) space parking garage <br /> consistent with the structural design and aesthetic standards of the City owned garage located at <br /> Heritage Park,associated landscape, irrigation work, underground drainage system,and as generally <br /> described in the revised schematic proposal submitted to the City on February 13, 2012; and <br /> WHEREAS,these additional amenities to the project will increase the guaranteed maximum <br /> price of the project from Ten Million Seven Hundred Thousand Dollars($10,700,000.00)to Sixteen <br /> Million Five Hundred Thousand Dollars ($16,500,000.00). <br /> WHEREAS, the City Commission wishes to approve the Initial Design for Gateway Park <br /> and Parking Garage, a Second Amendment to the Design/Build Agreement, and a Tax Exemption <br /> Agreement. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Approval of Initial Design. The City Commission hereby approves the Initial Design <br /> submitted on or about February 13. 2012 by the Contractor for Gateway Park and Parking Garage, <br /> attached hereto as Exhibit"A". Any material revisions to the Initial Design must by approved by the <br /> City Commission. The City Commission hereby accepts the donation of a temporary construction <br /> wooden panel fence with a mural from 4M Investors. <br /> Section 2. Approval of Second Amendment to Design-Build Agreement. The Second <br /> Amendment to Design-Build Agreement between the City of Sunny Isles Beach and 4M Investors, <br /> LLC, for the final Site Plan for a Park and Parking Garage in Gateway Park, in accordance with the <br /> revised schematic proposal submitted to the City on February 13, 2012, and the revised Guaranteed <br /> Maximum Price Proposal dated March 20, 2012,attached hereto as Exhibit"B",is hereby approved. <br /> Any Change Order must be approved by the City Commission. <br /> 82012-4M Investors 2nd Amd w Agmt Gateway Park Page I of 2 <br />
